MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> MARCH 12, 2025 <br /> Mr. Borselli demonstrated the revisions made to the plan that the two-car garage <br /> had dimensions of 25'x 25'and was significantly larger. The existing conditions plan <br /> set shows more detail that the house exists virtually on the edge of the pond. The <br /> new house is shown pushed back from the pond and measures 24'x 40'. The original <br /> plan had a two-car garage that was situated close to the pond and has since been <br /> removed from the application. The revised plan has since been designed so that the <br /> garage is situated under the proposed house to provide parking, and has resulted in <br /> the first floor of the house to be elevated one story. <br /> The new plans were presented to the Board of Health for the proposed septic system. <br /> The existing house was originally serviced by a cesspool which is substandard in <br /> every way under the State sanitary code and in the local health regulations. The <br /> proposed IA denitrification system is far superior, and will be situated as far back <br /> from the pond as much as possible. These proposed improvements are very <br /> significant than the existing situation. Mr. Goldstein pointed out that he only had <br /> the original house plans depicting the two-car garage. Mr. Borselli had a revised <br /> house plan. <br /> Mr. Furbush asked how high the house will be lifted. Mr. Borselli said; 9 feet. Mr. <br /> Furbush asked if the house was situated in a flood zone. <br /> Mr. Morris said; no, this house is not situated in a flood zone. It is not a coastal <br /> residence. <br /> Mr. Furbush asked if the elevation of the road was slightly higher than the lot. Mr. <br /> Borselli said that the new renovations will provide regrading, and there will be a new <br /> rain garden with natural vegetation with a 2 ft. deep swale and twice the capacity <br /> for this site. <br /> Mr. Goldstein reviewed the revised site plan depicting the proposed deck at a full 40 <br /> ft. x 12 ft. However, the original house plans show a 40 ft. x 10 ft. deck. He wants <br /> to make sure that the Board has the correct plans for the recorded decision. <br /> Mr. Morris noticed a five ft. retaining wall and asked for an explanation. Mr. Borselli <br /> explained that Title 5 requires separation from ground water to the bottom of the <br /> septic system and has to be elevated so the elevation is accomplished by creating a <br /> wall around the septic system and installing the system inside the wall. <br /> Mr. Furbush asked if the wall is considered a structure. Mr. Morris said; yes, it is <br /> considered a structure under Zoning, and is quite substantial. Mr. Morris said that <br /> this wall needs to be situated 5 ft. from the property line; it is measured by width <br /> and length. Mr. Morris said that under Zoning this wall is considered a non- <br /> habitable structure, and should be setback 5 ft., and should be included in lot <br /> coverage. <br /> 2 <br />
