MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> MARCH 12, 2025 <br /> Mr. Borselli said that the wall is 2 ft. wide, and is 2 ft. off the property line. <br /> Mr. Morris mentioned that the setback might need to be setback 15 ft. <br /> The Board was not comfortable to move forward because the site plans and building <br /> plans did not match, and there were questions regarding the retaining wall. <br /> Mr. Borselli stated that he was not aware that the retaining wall was considered a <br /> structure. If the wall needs to shifted, he will have to revise the plan. The other issue <br /> was the deck dimensions on the house plans. <br /> Mr. Reidy mentioned the site plan needs to be accurate in order for the Board to <br /> make a determination. <br /> Ms. Sangeleer said there are three major issues. The lot coverage needs to be revised <br /> in regard to the retaining wall being a structure, the retaining wall setbacks and <br /> height measurements need to be confirmed, and may require a 5 ft. or 15 ft. setback, <br /> and the deck dimensions need to be revised on the building plans. <br /> Attorney Wall asked for a continuance until April 23, 2025. <br /> Mr. Reidy made a motion to continue the hearing until April 23, 2025. Mr. Furbush <br /> second. All were in favor. <br /> 24 Seconsett Point Road: Owners, Joshua and Nicole Delman request a Variance <br /> under§174-31 (Land Space Requirements), and §174-33 (Setback to wetlands) of the <br /> Zoning Bylaws to vary the lot coverage and setback to wetlands to allow for <br /> construction of a single-family residence on property located in an R-3 Zoning <br /> District, Map 124, Parcel 35, Mashpee, MA. (Continued from 11113124, 12111124, <br /> 118125, and 2112125 at the request of the Attorney). <br /> Sitting on this hearing are the four regular Board members, and Mr. Caggiano. <br /> Attorney Kirrane submitted a letter requesting a continuance until March 26, 2025. <br /> Mr. Furbush read the letter into the record. Mr. Reidy made a motion to accept the <br /> continuance. Mr. Blaisdell, second. All were in favor. <br /> 123 Tide Run: Owners, Kevin H. and Maryellen M. Kelley request a Variance under <br /> §174-33 of the Zoning Bylaws to allow for expansion of an existing rear deck on <br /> property located in the Little Neck Bay cluster subdivision, and the R-3 Zoning <br /> District, Map 120, Parcel 182, Mashpee, MA. A Variance was issued by the Board <br /> back on March 27, 2019 (V-2019-19) and expired. <br /> 3 <br />
