MASHPEE ZONING BOARD OF APPEALS MEETING MINUTES MARCH 12, 2025 Mr. Strick asked to withdraw his Variance request without prejudice. Mr. Reidy made a motion to accept the withdrawal. Mr. Blaisdell, second. All were in favor. Mr. Reidy read an abutter letter into the record and approves of the project. Mr. Reidy read the Conservation Commission Administrative Approval. The Board of Health comments; no increase in habitable space, no comments. There were no comments from the audience. Mr. Furbush asked the Board if there would be an issue if there were additional posts installed for the 6 ft. cantilever, and is it safe. Mr. Morris said that additional posts cannot be installed because it will change the whole proposal. Mr. Strick said he will submit it to a structural engineer for permitting to Mr. Morris. The Board agreed. Mr. Reidy made a motion to close public comment. Mr. Blaisdell, second. All were in favor. Mr. Reidy made a motion that the Board issue a Written Finding for 123 Tide Run with the following conditions: 1. The Board has determined that the applicant meets all the conditions of a Written Finding under Mass General Law 40A Section 6. 2. Sit Plan - Prepared for Kevin Kelley, 123 Tide Run, Mashpee, MA. Scale: 1" _ 20', Date: April 11, 2018. Prepared by Warwick & Associates Inc. 3. Building Plans: Prepared for Kelley Residence, 123 Tide Run, Mashpee, MA. Prepared by: Graven Architectural Design, Date: 6/7/24. 4. Conditioned on all Town Department comments read into the record including but not limited to the Board of Health and Conservation Department comments. 5. Any changes to the plans or structure will require the applicant to return to this Board. 6. Conditioned that the applicant seek and obtain the Building Department review in reference to the Tree Bylaw Chapter 175 of the Town Bylaws prior to the application of a building permit. 5
