Board of Selectmen
Minutes
March 27, 2000
APPOINTMENTS AND HEARINGS:
Public Hearing—James Morgan Livery License:
Selectman Marsters opened the Public Hearing on the application of
Upper Cape Transportation Corporation, d/b/a Mashpee Livery, for a
Livery License to operate at 25 Bowdoin Road,Mashpee.
Joyce Mason, Assistant Town Administrator read aloud the Public
Hearing notice as published. James Morgan was present to discuss the
Iicense application with the Board.
It was noted that the Town has approved the livery license of
Charles Roderick d/b/a Mashpee Livery. It is necessary that the
applicant change the name of doing business as.
A livery license is a public for hire vehicle, which is a contracted service
from a fixed address of pickup to a known and fixed destination for a set
fee. A taxi is able to freely roam the street or operate from known areas
such as a bus depot or boat discharge area. The fare is metered to its
destination. The same vehicle cannot be used for a taxi or livery license.
The Board was in receipt of alleged violations to the taxi cab operation of
Mr. Morgan. A brief discussion ensued. Mr. Morgan indicated that the
problem occurred with the recent purchase of a Sandwich livery company.
The Board agreed to discuss the above referenced matter with Sergeant
Umina of the Mashpee Police Department.
Selectman Marsters opened the Public Hearing to obtain comment.
Mr. Bartolomei stated that the applicant has a conflict of interest having a
.taxi cab license and requesting a livery license. It was noted that there
have been complaints where residents have called for a taxi and received
the service of a livery vehicle.
i '
Motion made by Selectman Taylor to close the Public Hearing.
Motion seconded by Selectman Leveille.
VOTE: Unanimous. 5-0.
