MA 02649 <br /> FINANCE COMMITTEE MINUTES <br /> Town Hall <br /> January 22, 1991 <br /> Present: Carole Dunivan, John Ferriday, Tony Gallo, Deirdre Greelish, Carl <br /> Heller, Vern Polka and Jim Vaccaro <br /> The Finance Committee meeting was called to order at 6:30 p.m. The <br /> Committee reviewed the minutes of the January. • 8th and January;T_4th; meetings. <br /> Carl motioned that the amended minutes of the 8th be approved, Vern seconded <br /> and there was unanimous approval. Carole motioned for approval of the amended <br /> minutes of January 14th, seconded by Tony and there was unanimous approval. <br /> Tony Gallo addressed the Committee regarding his possible conflict of <br /> interest status. He stated that he had written to Attorney Kaufman, Chief of <br /> the Legal Division of the State Ethics Commission regarding this matter. <br /> Tony informed the members that he was in receipt of a letter from Kal4fman <br /> which stated that he should not discuss or vote on matters pertaining to <br /> teachers salaries or any other item on the budget that may affect his wife <br /> financially. According to Tony the letter further stated that he may <br /> discuss school issues that do not affect his wife financially. Tony noted <br /> that he wanted to participate and vote on the total bottom line school budget <br /> figure. <br /> Tony's position would necessitate a change in the way the Finance <br /> Committee reviews the school budget. He proposes that the Committee remove <br /> line items dealing with salary and then he will discuss the rest of the line <br /> items. Members expressed concern as the bottom line figure of the school <br /> budget includes salary. Deirdre noted that it would be very difficult to <br /> to control and restrict discussion in view of Tony's status. Attorney <br /> Reardon, Town Counsel, addressed the Committee stating that the Finance <br /> Committee could only appropriate a sum of money for the school budget and <br /> could not make recommendations on expenditures within the school budget. <br /> He continued that the Committee must recommend an overall budget and by doing <br /> so may inadvertently confer a financial advantage on Tony's wife. <br /> Committee members expressed concern that it was the Mashpee Taxpayers <br /> Association pursuing the matter of confilct of interest. Attorney Reardon <br /> noted that a violation of the conflict of interest statute is criminal and <br /> may be punishable by a $3,000 fine and 2 years in jail. <br />
