7 <br /> Board of Selectmen <br /> Minutes <br /> April 24, 2000 <br /> .OLD BUSINESS: <br /> Execution of Purchase& Sale Agreement Als Property <br /> Correspondence was received from the Town Planner dated <br /> April 12, 2000 relative to the Purchase& Sale Agreement regarding the <br /> Land Bank acquisition of the Als property located on Goodspeeds Road, <br /> Mashpee for the sum of$330,000. <br /> The agreement was negotiated by the Town Planner and Director of. <br /> Assessing with the Als attorney, Stanley Nowak, and approved as to the <br /> above referenced purchase price by the Open Space Committee and is <br /> subject to Town Meeting approval. <br /> In actual negotiations, the parties agreed to defer payment of outstanding <br /> water betterments. The sum total is approximately $2,500. The Water <br /> District has been requested to abate the water betterment although there is <br /> no guarantee of such action. Discussion followed. Town Meeting action <br /> in October may be necessary to fund the betterment if the Water District <br /> does not abate the amount. <br /> In future agreements, the Board agreed to include specific language that <br /> all betterments be resolved before closure. In addition, all Purchase & <br /> Sale Agreements should contain consistent language. Item No. 4—Title <br /> Deed; Said premises are to be conveyed by a good and sufficient quitclaim <br /> deed running to the BUYER, and said deed shall convey a good and clear <br /> record and marketable title thereto, free from encumbrances, including. <br /> Motion made by Selectman Blythe to approve and execute the <br /> Purchase& Sale Agreement between the Town of Mashpee and Ann <br /> & Joanne Als as presented. <br /> Motion seconded by Selectman Cahalane. <br /> VOTE: Unanimous. 4-0. <br />
