3
Board of Selectmen
Minutes
June 19,2000
COMMUNICATIONS AND CORRESPONDENCE:
Tribal Council Memorandum of Understanding: (continued)
In response to Mr. Marshall's request for the Board to re-consider the use
of the law firm Hale &Darr in the recognition process, former Selectman
George Benway stated that for the Tribal Council to dictate to the Board
of Selectmen who shall be used as counsel in their negotiations is totally
ridiculous. The Board of Selectmen should not be dictated upon with
preconditions, and it is too costly to get new counsel up to speed. Mr.
Benway added that the 1978 rendition settlement was totally rejected by
the Tribal Counsel.
There was no action taken by the Board at this time.
OLD BUSINESS:
Execution of Orders of Tam
Als Property—Andrade Property Oakley Property—Peck Property_:
+ The Selectmen reviewed the Orders of Taking for the above referenced
properties.
Motion made by Selectman Taylor to approve and execute the Orders
of Taking for the Als Property, Andrade Property,Oakley Property
and Peck Property as presented.
Motion seconded by Selectman Cahalane.
VOTE: Unanimous. 4-0.
Discussion followed with respect to the Oakley Property. Tom Fudala, the
Town Planner indicated that three of the four parties have approved the
agreement. The remainder, approximately 20% of the interest represent a
group of heirs.
Motion made by Selectman Taylor to rescind past action, and not
approve the Order of Taking for the Oakley Property.
Motion seconded by Selectman Green.
VOTE: Unanimous. 4-0.
