Board of Selectmen <br /> Minutes 7 <br /> May 18, 1998 <br /> APPOINTMENTS AND HEARIKQS: <br /> Lake Management Committee: (continued) <br /> In an effort to provide a short term solution to the management of the pond, <br /> Mr. Whritenour, Executive Secretary recommended to conduct a semi-annual <br /> cleaning to begin,August 1, 1998 and again in March of 1999 before the <br /> herring run begins. <br /> In addition, continued monitoring is necessary informed Mr. Whritenour. <br /> The Division of Marine and Fisheries is expected to assist the Town in review <br /> of the water levels. <br /> Mr. Sherman indicated that the Town must abide by the Natural Heritage and <br /> Endangered Species Program and accept their conclusions. Unless you are <br /> managing the water level for herring, you cannot change the water levels <br /> without an Order of Conditions explained Mr. Sherman. <br /> It was noted that the historic level of the pond is 55.5 feet. <br /> OLD BUSINESS: <br /> New Scab=Reorganization Plan Discussion: <br /> Selectman Marsters stepped down for the above discussion. <br /> Vice-Chairman Frye presided. <br /> Town Counsel,Attorney Patrick Costello was present to review the above <br /> matter on behalf of the Town of Mashpee. <br /> It was noted that New Seabury Limited Partnership has filed for <br /> bankruptcy protection, and has subsequently filed a detailed reorganization <br /> plan. The plan proposes to satisfy the Town's claim for unpaid real estate taxes <br /> by transferring title to certain property owned by New Seabury Company to <br /> the Town of Mashpee. <br /> Correspondence was received from Town Counsel dated May 15, 1998 with <br /> respect to this regard. In addition,the Board received late filed correspondence <br /> from John Monaghan, counsel for New Seabury Limited Partnership dated <br /> May 14, 1998 relative to the ballot in favor of New Seabury Company's <br /> reorganization plan. <br />
