Board of Selectmen <br /> Minutes 8 <br /> May 18, 1998 <br /> OLD BUSINESS: <br /> New Seab=Reorganization Plan Discussion (continued) <br /> Town Counsel,Patrick Costello discussed the process. It was noted <br /> that an objection to the debtor's plan of reorganization was filed with <br /> Bankruptcy Court on February 23, 1998. <br /> I <br /> Several of the parcels proposed to be transferred to the Town are of <br /> little or no value to the Town. In addition, the objection stated that the <br /> acquisition of land by a Town requires a vote of Town Meeting and the <br /> Board of Selectmen, which has not taken place. <br /> It was noted that the Treasurer/Tax Collector executed a ballot indicating <br /> acceptance of the plan and expressed preference for the plan over the <br /> competing plan of New Seabury Properties. <br /> Anne Shaw, the Treasurer/Tax Collector was not present to discuss this <br /> matter. The Board of Selectmen did not review the ballots prior to the <br /> deadline for submission on April 23, 1998. Selectman Caffyn related concern <br /> with respect to this regard. A hearing is scheduled in the Bankruptcy Court <br /> on May 29, 1998. <br /> Motion made by Selectman Caffyn to authorize Town Counsel to <br /> file a general notice of appearance on behalf of the Town of Mashpee. <br /> Motion seconded by Selectman Leveille. <br /> VOTE: Unanimous. 4-0. <br /> Selectman Marsters stepped down. <br /> It is the consensus of the Board to further review this matter with Anne Shaw. <br /> Attorney Costello was advised to continue to update the Selectmen. <br /> Recess: 8:29 p.m. Meeting Resumed: 8:33 p.m. <br />
