Board of Selectmen <br /> Minutes b <br /> July 20, 1998 <br /> OLD BUSINESS: <br /> Order of Taking for Wildlife_Ref Pro}Lrt �, (continued) <br /> Due to the nature of title which John L. Druley is willing to convey to the Town, <br /> a mutually acceptable agreement has not been reached for the purchase of the <br /> property. <br /> It was noted that the subject property of woodland has been assessed by the <br /> Town to Owners Unknown. At the time of foreclosing the rights of redemption <br /> of said parcel due to non-payment of real estate taxes, Tremont at Union <br /> Limited Partnership(TAULP)petitioned the Land Court for the right to redeem <br /> its interest. <br /> A Land Court judge determined that TAULP did possess the legal interest <br /> required to allow it to redeem the tax title,but did not render opinion as to the <br /> nature of the title possessed by TAULP. <br /> Mr. Druley acquired the property from TAULP in 1998. The Town requested <br /> that he provide good and marketable title to the subject property. Mr. Druley <br /> agreed to provide insurable title which was not deemed sufficient by Town <br /> Counsel,Kopelman and Paige. The appraised value is $300,000. <br /> Mr. Druley was present to request the Board consummate this matter in an <br /> expeditious fashion. Discussion followed. It was noted that Town Meeting <br /> authorized the sum of$220,000 for the acquisition of said property. The <br /> Conservation Commission voted to contribute an additional $40,000 towards <br /> the acquisition. ORENDA, a private wildlife trust has agreed to contribute the <br /> $40,000 necessary for the acquisition in consideration that Town Meeting efforts <br /> will authorize reimbursement in October. <br /> Correspondence was received from Town Counsel dated July 16, 1998 with <br /> respect to this regard. ORENDA is expected to confirm its ability or inability <br /> to participate in the acquisition in a timely fashion. <br />
