BOARD OF SELECTMEN <br /> MINUTES Page 3 <br /> MONDAY, OCTOBER 29, 1990 <br /> I <br /> Ca pa Cod Mosquito Control Project: <br /> The annual assessment for the mosquito control service is <br /> $38 , 977, but Selectman Hanson would like to know where the money <br /> spent is going. <br /> Kevin Harrington .has indicated there are maps in his office <br /> locating the spray areas for the Selectmen and public to review. <br /> 7: 0 p.m, Mr. Burden re.: New Seabury Wastewater Facility: <br /> It is noted that S'eiectman Lawrence has 'stepped down for this <br /> hearing. <br /> Chris Burden was thankful for the support of ,the Board of Select- <br /> men and Board of Health to expedite matters with DEP to schedule a <br /> meeting. <br /> There were two hearings ,concerning the jurisdiction issue with <br /> the Cape Cod Commission. The first was the 15th of October and the <br /> second, the 25th of October. Mr. Burden believes over the weekend <br /> of the 20th of October, the decision went from legal criteria to <br /> political criteria. The Commission voted 3-2 that the jurisdiction <br /> was subject to the Commission. <br /> Most of the reason being the project is not in compliance, is <br /> that the project is neither for commercial or residential use and <br /> the wastewater treatment facility is a massive and industrial type <br /> not mentioned in the special .permit. . <br /> Mr. Burden is asking the Board for political actions to address <br /> the situation. He cannot believe it is non exempt the same way the <br /> special permit covering the area is exempt. <br /> The project will be delayed for two years and the new projects <br /> considered cannot wait that long-7-his includes the New Seabury Hotel <br /> expansion and the Village projects. <br /> Mr. Costa was surprised the vote had changed. Mashpee was prepared <br /> to have the project reviewed and New Seabury was prepared to pay the <br /> fee. Plant #1 is below size and does not require an EIR so it is not <br /> subject to be reviewed by the Commission. Plant #2 is of concern <br /> where MEPA has not made the determination of EIR. <br /> Selectman Jacobson- will meet with the Cape Cod Commission on <br /> November the 8th and will try to clarify the reason for the change . <br /> A project of this magnitude is what the people voted the Commission <br /> for. <br /> Chairman Carter has asked George Costa to seek_ more information <br /> on. Plant #1 and Plant #2 for clarification and for Mr. Burden to <br /> explore through counsel alternatives and define what may have happened <br /> at the meeting of October the 22nd. <br /> Kevin Harrington noted that we should not loose the potential <br /> benfit to the town with the project proposed in Plant #2 for the <br /> hotel conference center and the revenue derived.. <br />
