Walter briefly <br /> outlined what has transpired on this project and the concerns Design Review has had from <br /> the beginning. Biggest problem is not an engineering problem; rather it's more an owner's <br /> issue with land. Basically at issue: <br /> • Owner owns both sites but all buffer areas were used from other lot; and can't do that. <br /> Bottom line: If owner coming in on one parcel,then he's got to deal with the one <br /> parcel. <br /> • Has to develop with vegetated buffer and drainage. Can't use other lot for buffer. <br /> • Can't"double-dip". That is, can't use neighboring lot to accept all the penalties. <br /> • Owner could combine both lots and use as one development, but then couldn't sell <br /> other lot. <br /> Walter mentioned that evidently the owner went to Board of Appeals to try to get project <br /> approved, but issue was raised regarding curb cut off Sampson's Mill Road. <br /> Following in-depth discussion,the consensus was that it appeared to Design Review group <br /> that the best bet is to have curb cut off Falmouth Road. Walter will write a letter to Planning <br /> Board giving recommendation to do curb cut off of Falmouth Road. Copy of the letter will <br /> go to ZBA and to Engineer. <br /> Walter noted that the building is nice and set-up of the building is nice. He stated Design <br /> Review is willing to meet with the owner, if he wishes. <br /> Approval of August 21, 2002 Minutes <br /> Mary motioned to accept the minutes of the August 21 meeting.
