✓G� <br /> Mashpee Design Review Committee <br /> Minutes of Meeting Held Thursday, September 9, 2010 <br /> Mashpee Town Hall Meeting Room 3 <br /> Committee Members Present: Thomas O'Hara and Robert Nelson. <br /> Also Present: Richard Stevens. <br /> Absent: Tom Jalowy and George Petersen, Jr. <br /> Audience: Michael Richardson -- Board of Selectmen <br /> Thomas O'Hara called the meeting to order at 8:45 a.m. and apologized for the late start but he said <br /> he had expected other Committee members to attend this meeting. <br /> Signs <br /> Maffei Landscape Contractors, Inc. <br /> 28 Nicoletta's Way <br /> Approval of their permanent sign <br /> Robert Maffei appeared. Highlights of the discussion included the following: <br /> • Mr. Maffei said the original sign approved but it was considered a temporary sign and he didn't <br /> realize that. Tom O'Hara said when he moved the sign on the landscape plan Design Review <br /> Committee members don't remember approving. Tom said the Committee also doesn't recall <br /> - — approving-vegetation-that-is-there-because that vegetation-is-illegal. By taw calls for-natural -- <br /> vegetation and what is there is not natural. Mr. Maffei said there was absolutely nothing there; <br /> and that's why he planted the vegetation. He said you could see through to his site and that's <br /> why he planted something. <br /> • Tom O'Hara pointed out that Mr. Maffei has an approved, stamped plan but that the application <br /> is for 28 Nicoletta's Way, not Main Street. <br /> • Tom O'Hara noted to Mr. Maffei that the sign was approved as a temporary sign for 28 <br /> Nicoletta's Way. Tom O'Hara said you are not allowed to have an off-premise sign. Tom said <br /> he spoke with Tom Fudala and it is 2 lots and an off-site premise sign. Mr. Maffei said they run <br /> all their business out of the other lot. Mr. Maffei said his sanders, plants, cars, etc. are on that <br /> other lot and that's why he did expensive landscaping to hide all that. Mr. Maffei said <br /> everybody knew where the sign was going; he said he did exactly what Design Review <br /> Committee told him to do. <br /> • Tom O'Hara pointed out that lot 1 is 1.53 acres and does not have a building. Tom noted that <br /> the business is permitted on Nicoletta's Way; no business permitted on Main Street lot. Mr. <br /> Maffei said he disagrees; he is using that lot for his business. <br /> • Tom O'Hara explained that the issues to be faced are: (1) two lots; (2) application asking for <br /> sign at 28 Nicoletta's Way; and (3) Main Street is a separate lot. <br /> • Tom O'Hara said he wants it known that the sign is not 5 feet off the bike path and therefore is <br /> illegal. Tom pointed out he wanted to be sure this is.fully known for liability purposes. Mr. <br /> Maffei responded that from day one the sign was where it is now and that was 6 years ago. <br /> Tom O'Hara said we have to do this right. The wall that's there is illegal according to the By- <br /> Laws. <br />
