Minutes of Combined Meeting of <br /> Mashpee Design Review Committee/ <br /> Mashpee Plan Review Committee <br /> Thursday, February 11, 2010 <br /> Mashpee Town Hall <br /> Design Review Members Present: Plan Review Members Present: <br /> Walter Yarosh, Chairman Richard Stevens, Building Commissioner <br /> Bob Nelson Charles Maintanis, Building Dept. <br /> Tom O'Hara Glen Harrington, Health Agent <br /> Rodney Collins, Police Chief <br /> Sheldon Hamblin, Fire Dept. Deputy <br /> Joel Clifford, Fire Inspector <br /> Tom Fudala, Town Planner <br /> Andrew McManus, Conservation Agent <br /> Chairman Richard Stevens called the meeting to order at 9:00 AM <br /> 9:00 AM — Kathleen Muzerall— 16 Sewall Drive— Request to Operate a Day Care <br /> Kathleen Muzerall introduced herself to the Committee, stating that she has been <br /> operating a Day Care.business since 2002, and is licensed every four years by the <br /> State. Richard Stevens stated that when Ms. Muzerall came in to renew her license in <br /> January, 2010, it was discovered that she had never been before the Plan Review <br /> Committee for permission to operate a Day Care business, which is a Zoning Board by- <br /> law requirement. <br /> Richard Stevens read a letter received from Kathleen Smith of 15 Sewall Drive, an <br /> abutter to 16 Sewall Drive. Ms. Smith stated in the letter that Ms. Muzerall has been <br /> running the Day Care program at her home at 16 Sewall Drive with no problems to the <br /> neighbors for the last 8 years, and she has no objections to permission for renewal of <br /> her license. <br /> In a letter received from a second abutter living at 7 Butler Lane, it was stated that <br /> although the Day Care business run by Ms. Muzerall had never caused any problems for <br /> them, their only concern was with the possibility of grandfathering the continuing use of <br /> the property for a Day Care business upon the sale or transfer of the property. The <br /> abutters at 7 Butler Lane felt also that the Day Care program should be inspected by the <br /> i <br /> Town yearly, or as the permit is renewed. <br /> Ms. Muzerall stated that she is licensed to care for six children under the age of 5, and <br /> two school-aged children, but at the present time she has none. <br /> Walter Yarosh reminded Ms. Muzerall that she will need to go through the Building <br /> Department to ensure that her Day Care program meets the Building Code requirements <br /> for a Day Care business. <br /> Tom Fudala made a motion that the Day Care business conducted by Kathleen Muzerall <br /> at 16 Sewall Drive be approved, subject to inspection by the Mashpee Board of Health <br /> 1 <br />
