Rich Stevens said day care is allowed in any area in town provided they go through the process. Rich Stevens said that the Town by-laws require a fence or some type of secure perimeter protection around an exterior play area at child care facilities. Ms. Almeida said Department of Education & Care does not require fencing if you do not live in a busy area. She said they do have plans to eventually put a fence in but they have a huge yard; they have plantings in the back; and children are not out without supervision. Two employees take care of the children; they've had the day care there since June of last year; and have been with Department of Education for more than 10 years. Ms. Almeida said they also work with Carriage House. The Committee explained that she wouldn't have to fence in the whole yard; just fence in the play area so the children cannot wander off_ Ms. Almeida said that would be acceptable. Sheldon Hamblin suggested that at a minimum he and Rich Stevens need to do an inspection. Ms. Almeida said she will wait for the inspection and then maybe they can give her specifics. Sheldon pointed out they would need a Plot Plan. Rich Stevens said he believes a Plot Plan would be in the file since the house was only built about 3 years ago. Ms. Almeida said they have to have insurance of$1-Million for each child. Rich Stevens said she may be required to have a business certificate issued by the town, Ms. Almeida said she will check with the Town Clerk on this. Ms. Almeida said they get almost half of what day care normally gets paid because they are considered "home care", not "day care". She said they do not get paid as a business; they cannot advertise as a business. Public comment portion ended. Some concerns raised by the-Committee- 1. No permits were obtained for the conversion renovations of the garage to a day care room, including the garage door renovations. 2. Permit needed for electric heat in garage. 3. Outside play area has to be enclosed so children cannot wander from the area. 4. Applicant to check with Town Clerk to determine whether_or_not-a business certificate is- - - required. — 5. Rich Stevens and Sheldon Hamblin to do site inspection with Plot Plan so they can then determine specific requirements. 6. Something to be placed in front of garage doors to prevent vehicle from inadvertently smashing into the garage door...this is a major safety issue. CONCLUSION: Charlie Maintanis motioned the Committee accept the day care under the conditions as presented; Tom O'Hara seconded the motion; and the motion was unanimously approved. Approval of Minutes... Charlie Maintanis motioned the minutes of the Plan Review Committee held May 13, 2010 as presented be approved; Richard Stevens seconded this motion; and the motion was passed.
