Attorney McElhinny responded that the abutters have not reviewed the current <br /> plan, communication has been made with some of the abutters, and that the majority of <br /> revisions have been made as a result of abutter concerns expressed at the last meeting. <br /> Mary Waygan inquired as to the status of relocation of the ancient way; to which <br /> Attorney McElhinney responded that relocation is no longer being proposed, that the <br /> ancient way is going to be maintained at its current location and will become the frontage <br /> for the proposed units. <br /> The Town Planner asked about the location of tees where a paved roadway is <br /> being proposed;to which Attorney McElhinny responded that particular tee is rarely <br /> used and that he does not consider this to be a safety issue. <br /> Dennis Balzarini asked whether this portion of land is part of the original <br /> Willowbend development or a more recent purchase of 10-acres of land; to which. <br /> Attorney McElhinny responded that the proposed areas actually straddles the original. <br /> property line, 6-acres within the original property and 5-acres outside. <br /> . Dennis Balzarini also asked whether the abutters are in agreement with the size of <br /> the proposed development. <br /> Attorney McElhinny responded that there are abutters present at the meeting and <br /> may present their feelings on the matter. He stated that the proposed 48-units are in <br /> compliance with the zoning allowed under their density and that they are making every <br /> attempt to made adjustments according to abutter concerns. He did acknowledge that this <br /> portion of the property, if approved, would then become included as part of the existing <br /> Special Permit. <br /> The Town Planner clarified that there is a limit on the number of units allowed <br /> under the Special Permit that does not include the proposed development and that the <br /> Board is being asked to increase the number of units. <br /> Attorney McElhinny stated that 13-units are currently allowed under the existing <br /> Special Permit for the proposed area and that the increase would be for 35-units. <br /> James Leonard asked if there would be any impacts/delays upon the proposed <br /> development with regard to National Heritage issues. <br /> Attorney McElhinny stated that there should be no delays with the process and <br /> that their regulations provide for grandfathering for projects that were in process prior to <br /> the mapping. The proposed project was filed in April 2008 and the mapping did not <br /> occur until October 2008. Applicant can move forward to build what has already been <br /> approved, 13.-single family homes with no restrictions in terms of impact to the habitat. <br /> The Chairman raised the question and his concern regarding height restrictions, <br /> and the request for approval of more than the 35-foot allowance. <br /> 4 <br />
