Secretary, Joseph Murphy, <br /> Jr. , and Administrative Assistant, Joyce Mason. <br /> Excerpt of meeting with Developer John Umina and his .attorney, <br /> Bruce Gilmore, re: William Mingo Road. <br /> Terry: Have you seen the letter here, from .Mr. Reardon dated <br /> October 21? <br /> Gilmore: Yes, I. have. <br /> Terry: Maybe you can show it to Mr. Umina to see if he has <br /> any further thought. Just . hold on to this. <br /> Gilmore: I. don't have any difficulty with the proposal that has <br /> been advanced by town counsel. I .assume it is a rec- <br /> ommendation to the board. What I think I'm concerned <br /> about, if I '.can articulate very briefly, is simply <br /> practicality. The engineer that. Mr. .:.Umina has hired <br /> is a. very competent, well-recognized man. He has the <br /> ability to work ,with Mr. . Rowley(Town Engineer) ,. who <br /> is a consultant to the town and to the planning board, <br /> in terms of the layout. Because of the mechanics of <br /> the layout acceptance of. a , quote, "public way" , there <br /> is necessarily a time lag and it seems to me that the <br /> status of William Mingo Road is that of a public way, <br /> whether it is by prescription or whether it is by ancient <br /> way status, whatever status it might enjoy, is quote <br /> "a public way" and recognized. by the Land Court. What <br /> I propose is that once it. is determined by the town <br /> engineer, Mr. Rowley, and Bill. Nye as to where the..-road <br /> should be laid out in terms of its 401foot layout, that <br /> we be granted permission, so long as it is within either <br /> the property of Mr. Umina or the property of the Town <br /> of Mashpee, that it be laid_ out because, as I understand <br /> it from the records, those are the . only parties involved, <br /> the 'Town of Mashpee and Mr. Umina, and that we be allowed <br /> to pave it, and the formality of the town meeting vote <br /> at a later point in time would certainly be beneficial <br /> to the town but not imperative to our getting the road <br /> put in place and, again, we indicated to the planning <br /> board and I reiterate to this board, -that .we would con- <br /> struct that relatively short stretch of road up to the <br /> standards of the Town of Mashpee Planning Board. <br />
