MASHPEE SELECTMEN'S MEETING -1Q/23185 Page 2.
Terry: I don' t have any problem with it as long as Charlie
Rowley, you know, he' s usually very much interested
to detail in that. I don' t know exactly the ramifi-
cations somewhere along the line if the town were to
turn it down, whatever it is , whether that puts you
at risk or not. I mean, you know more about that then
I 'do in this particular situation. All I'_m saying is,
you are presupposing again the town has to layout some-
where down the line, you want to get moving.
Umina: That' s correct.
Terry: Okay. I'm not going to act as your counsel for you.
Gilmore: The long and short o.f it is, .it seems to me, is that
we construct the road at our peril.
Terry: Right..
Gilmore: And .the road ha.s to meet the specifications of the Town
of Mashpee,' If the town opts, not to accept it, and
when I say the town, town meeting assembled opts not
to accept it, in a vote, I ,don't know if that answers
the question because the status of the road, I think,
most people in the Town of Mashpee, particularly old-
timers, would say, "darn it, that' s a town road. "
Whether it' s . legally a town road for purposes of li-
ability under. Chapter 84., I. really 'don't care about.
Terry: All I suggest is that you submit some kind of layout
to Charlie Rowley and if Charlie has any problems with
it, I'm sure he' ll get back to Mr. Reardon or us. Okay?
Gilmore: We have had .reasonable success-in meeting whatever re-
quest Mr. Rowley has made with. respect to the road,,.-
the access, the subdivision in particular. And I see
no reason why we cannot continue to work .with him on
this road, this small stretch ,of road.
Terry: Jean orWill., do you h.ave.,any thoughts?
Thomas: My thing. is, I'm going to go by what JQe Reardon says
here, a taking should be made of it.
Gilmore: I don' t follow that.
Thomas: All right. I don' t think we should put the cart before
the horse.
