Planning Board Meeting <br /> Minutes of June 5, 1985 Page 2 <br /> Public Hearing - Sub-Division of Land Located on Rte. 28, cont. <br /> Making reference to a letter dated May 17 from the Board of Health, Chairman Dubin asked <br /> Mr. Nye if they had received it? Mr. Nye said that he answered the Board of Health letter <br /> on June 4.via certified mail. <br /> Going back to the situation on the lot, Chairman Dubin asked Mr. Nye to explain? Mr. Nye <br /> said that the original preliminary showed lot 12 as two lots and that the zoning calls for <br /> 40,000 sq. ft. Because of the shape and the fact that there would not be very much build- <br /> able area, the Planning Board asked that two lots be eliminated and that all agreed to com- <br /> bine lot 12. <br /> Chairman Dubin said that they recommended that Lot 1 be incorporated into Lot 2 and that <br /> lot 13 be partly incorporated into lot 12. Mr. Nye agreed that they had discussed it and <br /> found out that you could put close to a 4,000 sq. ft. building on lot 1 . Chairman Dubin <br /> said that aesthetically it is a tough spot to put a building up if you plan to put a buffer.. <br /> subject--w -th--the Planni7ng�Board-reques-tr that lots 1�a _2 be -- <br /> combined and that he re-divide lot 12 and 13.* The board also stipulated that there would <br /> be no removal of vegetation 300 feet back on lot 1 (except what has to be done with drainage) . <br /> not considered to be a building lot. <br /> Mr. Nye asked that Board what they recommended for Great Hay Road. Chairman Dubin replied <br /> that they should bring Great Hay Road out and up to standards. Mr. Nye asked if the Board <br /> wanted a sub-division plan or approval not required? Chairman Dubin replied "a sub-division <br /> plan". <br /> Mr. Rowley asked Mr. Nye who the abutter was on the other side of Great Hay Road.- Mr. Nye <br /> replied that the Town of Mashpee is the abutter. Mr. Rowley asked if they should have been <br /> notified as an abutter? Mr. Nye asked if they normally required notification of abutters on <br /> the opposite side of the road? Mr. Rowley replied "not normally, but there was no layout and <br /> the ownership goes to the indication made". Chairman Dubin commented that for the purposes <br /> of that plan, it did not make that much difference, but for the other plan it will be required. <br /> Access of the sub-division was discussed. Mr. Nye commented that it would be subject to a <br /> covenant. Richardson Jonas commented that a notation should be made on the plan that it is <br /> not a buildable lot up intil the time the road is constructed. <br /> The Board continued the hearing until their meeting of June 19 requesting that it be scheduled <br /> at the beginning of their agenda. <br /> Public Hearing - Sub-Division of Land located on West Side of Great Neck Rd. at intersection <br /> of Great Hay Rd. Petitioner: Paul Tsimortos <br /> Chairman Dubin read the public hearing notice. The Board reviewed the Plan Review Summary <br /> presented by the Town Engineer. <br /> Mr. William Warwick was present to represent the petitioner. He sa' at a t meet- <br /> Mr. Tsimortos was also present during the hearing. <br /> Mr. Rowley commented that there substantial changes in the grade and elevation on the profile <br /> plan. Requirements are that the sidelines and the center line by shown. <br /> Mr. Warwick commented that it was going through a kelly hole and that the rest of it is flat. <br /> He said that he could show it but it would be a mish-mash. Mr. Warwick commented that they <br /> tried to situate the lots so that they will be in the depression and that they would not be <br /> contributing any drainage. <br />
