He recommended Applicant <br /> go through the process . <br /> Don Myers stated his agreement with the previous <br /> speaker, stating he would find it difficult knowing there <br /> were two (2) legally valid plans on record for the same <br /> property. If the intent is stated, Applicant should <br /> proceed under the applicable Definitive Plan process, and <br /> that this matter does not meet ANR requirements . <br /> Steve Dolan expressed a tendency to agree stating that <br /> he would expect Applicant would want to clarify this <br /> matter. Whether the Board is legally required to sign the <br /> ANR plan is unclear to him at the moment . <br /> Mr. Aucoin stated that both he and his client have <br /> been intent on determining the best action to take in order <br /> to approve a plan within the client' s timeframe. He stated <br /> there have been numerous conversations with the Town <br /> Planner in order to do so. <br /> The Town Planner reiterated the Board has previously, <br /> on another matter, signed an ANR Plan over an existing <br /> subdivision, not requiring the definitive process based <br /> upon Town Counsel recommendation. If the proposed ANR Plan <br /> meets the frontage requirement, it cannot be denied. <br /> _—._ _The Consulting Engineer_ asked whether the frontage____ <br /> requirements are as they exist, or would street lines <br /> disturb the frontage should they be calculated into the <br /> plan. <br /> The Chairman suggested the Board take more time to <br /> decide this matter, as she is uncomfortable approving the <br /> plan as it exists . <br /> Mr. Aucoin made reference to time constraints, asking <br /> if the plan requires additional lines, would it be <br /> sufficient to submit at the next Planning Board Meeting. <br /> He requested the Board advise him in this regard. <br /> Dennis Balzarini stated he would be satisfied if the <br /> Applicant submitted a plan showing the roadways . He noted <br /> there is one owner for the majority of the property, <br /> suggesting an easement/permission be obtained from the <br /> owner of the front lot, if this is in fact the case . <br /> 4 <br />
