General <br /> Only those plans which constitute "subdivisions" as <br /> that term is defined in Section III require the approv <br /> al of the Planning Board. However, all plans, whether <br /> "subdivisions" within the meaning of the law or not, <br /> ' must have either approval as a subdivision, or en- <br /> dorsement that they do not require approval, before <br /> they will be accepted for recording at the Registry of <br /> ' Deeds or registration at the Land Court. <br /> 2. The Planning Board will consider plans at meetings <br /> ((' only, provided the owner of the property or his repre- <br /> sentative is present, whether such plans be ones sub- <br /> mitted for endorsement of approval not required, Pre- <br /> liminary Subdivision Plans, or Definitive Subdivision <br /> 6i Plans. <br /> B. Plans Believed Not To Involve A Subdivision <br /> Any person who wishes to cause to be recorded in the <br /> Registry of Deeds or with the Land Court a plan of <br /> land and who believes that his plan does not require <br /> ,. approval under the Subdivision Control Laws, may <br /> submit his plan, application Form A, and required <br /> Jt: fees (see schedule) to the Board at a regularly sched- <br /> uled meeting, either in person or by a representative. ! <br /> t Such plan shall be accompanied by the necessary evi- <br /> dence to show that the plan does not require approval. <br /> ai Plans that indicate a non-conformance with an <br /> � y pro- y <br /> vision of the Zoning By-law will not be finally acted <br /> fir ' <br /> upon unless or until the plan has been modified to j <br /> jy eliminate such non-conformance or a variance has <br /> 1 been obtained from the Board of Appeals. Said person <br /> shall file, by delivery or registered mail, a notice with <br /> f the Town Clerk stating the date of submission for <br /> such determination and accompanied by a copy of <br /> said application.
