Article V. RULES AND REGULATIONS RELATIVE TO THE <s <br /> DREDGING AND FILLING OF. WATERWAYS <br /> AND MARSHLANDS WITHIN THE TOWN <br /> Section 1. All applications for a permit to dredge or fill <br /> must conform with State and Federal statutory rules or <br /> requirements. <br /> �1' � I?f_ <br /> Section 2. All applications must be in writing or on a <br /> form prepared by the Board of Selectmen and available at <br /> the office of the Town Clerk and shall be accompanied by a <br /> filing fee of ten dollars. <br /> Section 3. An application for a permit shall state: i <br /> � I <br /> a) The name and address(es) of the owner(s) and occu <br /> pant(s) of the land effected. i <br /> b) The exact area sought to be dredged or filled, identify j <br /> by land marks or monuments or by an accurate plan <br /> or survey of the land, marsh, or waterway effected. K <br /> Section 4. A public hearing shall be held on every ap- <br /> plication, which hearing shall be advertised at least seven <br /> days before the date of the hearing. <br /> Section 5. Any person violating the provisions of this <br /> By-Law shall be punished by a fine not to exceed $20.00 for,' <br /> each offense. '{ <br /> Article VI. REMOVAL OF SOIL, SAND AND GRAVEL AND <br /> SAND PITS <br /> Section 1. No top soil, sub soil, gravel, sand or other <br /> earth may be removed from the Town of Mashpm without <br /> first having obtained a permit from the Selectmen. A permit ~ <br /> with conditions imposed where necessary may be issued for F. <br /> the removal of top soil, sub soil, gravel, sand, and other }} <br /> earth if the Selectmen, after a public hearing, shall so order, <br /> Provided that no such permit shall be granted except upon I <br /> written application and after a public hearing of parties <br /> interested and consideration of their evidence by the Select- <br /> men; notice of said hearing being given by publication of <br /> the time and place thereof in a local newspaper not less than <br /> two weeks before said hearing, the expense of publication to <br /> be borne by the petitioner. After such a hearing, the Select- <br /> men shall render a decision in writing, stating the'decision <br /> and the reason thereof to the applicant. Such permit may <br /> be removed. <br /> Section 2. No top soil or sub soil shall be removed from <br /> place to place within the Town of Mashpee from an area of G; <br /> ground consisting of more than 500 square feet unless the <br /> person removing such top soil or sub soil shall replant an- <br /> 30 <br /> j �: <br />
