No sand or gravel shall be removed from <br /> ' place to place within the Town of Mashpee, except that, a <br /> sand gravel pit may be opened and used for such purposes,if it is located 100 feet or more from a street line and no <br /> f more than one entrance and one exit can <br /> sand and gravel pit is opened and used, the owner shall burn <br /> or cart to the town dumping area all dead trees and stumps <br /> when any area thereof amounting to more than 5,000 square <br /> s{ feet becomes unsuited for further use, and in such case, such <br /> area shall be replanted with trees or shrubs to prevent soil <br /> 1 +; erosion. <br /> Section 4. The foregoing By-Laws shall not apply to <br /> ;f land in public use nor shall the <br /> y •apply to the case of ma- <br /> r { terials removed or excavated for the purpose of improving, <br /> 1� grading, landscaping or cultivating the lot in which the soil, <br /> sand, gravel or other earth is located, nor for construction of <br /> buildings and the making of public or private improvements. <br /> ` Article VII. REGULATIONS RELATIVE TO GOOD ORDER <br /> Section L Anti-Noise By-Law, (A) By-Law Prohibiting <br /> Unnecessary, Excessive or Unusual Noises. <br /> It_shall be unlawful for any person or persons occupying <br /> or having -charge of any buildings or premises or any part I thereof in the Town, other than that section of any estab- <br /> lishment licensed under Chapter 138 of the General Laws to <br /> cause or suffer or allow any unnecessary, loud, excessive or <br /> r unusual noises in the operation of any radio, phonograph or <br /> uf. <br /> other mechanical sound making device -or .instrument, or re- <br /> p <br /> roducing device or instrument or in the playing of any band orchestra, musician or group of musicians, or in the use of <br /> any device to amplify the aforesaid, or the making of loud <br /> i outcries, exclamations or other loud or boisterous noises or <br /> loud and boisterous singing by any person or <br /> sons or in the use of any device to amplify the aforesaid <br /> noise where the noise is plainly audible at -a distance of one <br /> { hundred and fifty feet from the building, structure, .vehicle <br /> F or premises in which or from which it is produced. The fact <br />" that the noise is plainly audible at a distance of one hundred <br /> r ' and fifty feet from the vehicle or premises from which it <br /> 'I originates shall constitute Prima-Facie evidence of a vio- <br /> lation of this by-law.
