- 3
As a result of subsequent adoption or amendment of certain
provisions of the Zoning By-law , the Site and construction thereon
of a dwelling will not comply with certain land space requirements
of the current Zoning By-law. Section 5 .52 of the Zoning By-law,
however, provides that if one undeveloped, nonconforming lot was
held in ownership separate
from that of all adjoining undeveloped lots on January It
1985, or at the time it became nonconforming, whichever is
later, one single family residential building and its
permitted accessory buildings and improvements may be built
on that Lot, provided that the lot contains at least five
thousand ( 5 ,000 ) square feet of area and fifty (5U ) feet of
frontage.
The Applicant submits that the Site is a nonconforming lot
eligible for the protections set forth in Section 5. 52 of the
Zoning By-law in that the land space requirements at the time the
plan of the Site was recorded would have allowed construction of a
single family dwelling as proposed by the Applicant without a
special permit, variance or other zoning reliet. Subsequent
thereto, the minimum lot area, frontage , and yard requirements
were increased as set torth below so that construction of a single
family dwelling on the Site will not comply with the current land
space requirements of the Zoning By-law. The land space
requirements on the date of recording of the plan for the Site,
the actual land space dimensions of the Site upon construction of
a single family dwelling and the current land space requirements
are as tollows:
