- 3 <br /> As a result of subsequent adoption or amendment of certain <br /> provisions of the Zoning By-law , the Site and construction thereon <br /> of a dwelling will not comply with certain land space requirements <br /> of the current Zoning By-law. Section 5 .52 of the Zoning By-law, <br /> however, provides that if one undeveloped, nonconforming lot was <br /> held in ownership separate <br /> from that of all adjoining undeveloped lots on January It <br /> 1985, or at the time it became nonconforming, whichever is <br /> later, one single family residential building and its <br /> permitted accessory buildings and improvements may be built <br /> on that Lot, provided that the lot contains at least five <br /> thousand ( 5 ,000 ) square feet of area and fifty (5U ) feet of <br /> frontage. <br /> The Applicant submits that the Site is a nonconforming lot <br /> eligible for the protections set forth in Section 5. 52 of the <br /> Zoning By-law in that the land space requirements at the time the <br /> plan of the Site was recorded would have allowed construction of a <br /> single family dwelling as proposed by the Applicant without a <br /> special permit, variance or other zoning reliet. Subsequent <br /> thereto, the minimum lot area, frontage , and yard requirements <br /> were increased as set torth below so that construction of a single <br /> family dwelling on the Site will not comply with the current land <br /> space requirements of the Zoning By-law. The land space <br /> requirements on the date of recording of the plan for the Site, <br /> the actual land space dimensions of the Site upon construction of <br /> a single family dwelling and the current land space requirements <br /> are as tollows: <br />
