Sections 7 . 2 and 7 .4 ( 12) of the Zoning By-law, <br /> which were adopted on December 2, 1985, however, indicate <br /> that wetlands may not be included in determining compliance <br /> with zoning requirements and that only upland areas may be <br /> counted toward minimum lot size requirements. It wetlands <br /> are excluded and only upland included, the Site nonetheless <br /> contains at least 5 ,000 'square feet of land, as required by <br /> Section 5 .52 of the Zoning By-law. The house will be <br /> constructed entirely within the upland area of the Site. <br /> ( 2) The rear yard setback is calculated without regard to <br /> wetlands . Section 7 .2 of the Zoning By-law, which was <br /> adopted December 2, 1985 , indicates that yard spaces shall <br /> not include any wetlands . No such requirement existed on <br /> April 28 , 1970 , the date of recording of the plan for the <br /> Site ( See Section 5 . 5 of the Zoning By-law re : nonconforming <br /> lot) . <br /> ( 3) The house to be constructed is set back six feet from the <br /> wetlands. Section 7 . 7 of the Zoning By-law, which was <br /> adopted on December 2 , 1985 , requires that any building be <br />
