F 4 w <br /> - 6 - <br /> required for such construction inasmuch as such dwelling will have <br /> its lowest floor ( including basement) elevated to not less than <br /> the base flood elevation as required by Section 11 (1) of the <br /> Zoning By-law. Based upon the foregoing , the Applicant requests a <br /> determination from the Board of Appeals that provided that the <br /> lowest floor ( including basement) of such dwelling is elevated to <br /> not less than the base flood elevation, no Special Permit pursuant <br /> to Section 11( 5) of the Zoning By-law, variance or other zoning <br /> relief is required for construction by the Applicant of a single <br /> family dwelling on the Site. <br /> Areas Of Critical Environmental Concern. The Applicant <br /> previously submitted an application to the Mashpee Conservation <br /> Commission pursuant to Secton 4. 3 of the Town of Mashpee By-laws <br /> with respect to construction of the Dock and a single family <br /> dwelling. At a hearing before the Mashpee Conservation Commission <br /> on such application, a question was raised with respect to the <br /> need of the Applicant to obtain a special permit, variance or <br /> other zoning relief pursuant to Section 11C of the Zoning By-law. <br /> The Applicant submits that the Site is not within the Waquoit Bay <br /> Areas of Critical Environmental Concern ( "ACEC" ) or within a <br /> buffer zone extending twenty-five feet landward of such ACEC. A <br /> copy of such ACEC is attached hereto. Based upon the foregoing , <br /> the Applicant requests a determination from the Board of Appeals <br /> that no Special Permit, variance or other zoning relief pursuant <br />
