7 <br /> MINUTES April 1, 1987 BOARD OF APPEALS <br /> Ms. Hawver stated there is a new boat ramp directly across Okway <br /> Bay from the site. <br /> Mr. Hanrahan stated it has been established that under Section 6.9 <br /> subsection I-9 of the Mashpee Zoning By-Laws this Special Permit request <br /> for a dock would cause substantial damage to the marine environment and <br /> motioned to deny this request for a variance, Mr. Sexton seconded, all <br /> agreed. <br /> Thomas Cos ,rove - Reque3ts a Variance under Section 7.4 of the Land <br /> Space Requirements for permission to vary the front and sideline setback <br /> requirements in a R-5 Zoning District on property located on Lot 2062 <br /> Shorewood Drive, (map 58, parcel 36) , Mashpee Massachusetts. <br /> Members sitting: W. Hanrahan, C. Hawver and T. Sexton <br /> Mr. David Sanicki was in attendance representing Mr. Cosgrove, Mr. <br /> John Varkonda, Conservation Officer, was also in attendance. There were <br /> no abutters present. <br /> Mr. Sanicki stated the original house was layed out to conform with <br /> the current zoning requirements. He stated the Conservation Commission, <br /> because of the topographical features of the lot, suggested the placement <br /> of the house to be more beneficial environmentally if moved forward, <br /> towards the street, versus disturbing the top of the bank. <br /> Mr. Sanicki stated through further recommendations and requests, we <br /> have applied for a Variance to relocate the house as shown on plans pre- <br /> sented. He stated they would like to relocate the house 21 feet back <br /> from the street and 15 feet in from the sideline. Mr. Sanicki stated if <br /> the Variance is granted for the siting of the house, we will then proceed <br /> and revise the title V plans accordingly to suit the topographical fea- <br /> tures and return to the Conservation Commission with a new house location. <br /> Mr. Varkonda presented himself before the Board and stated the Con- <br /> servation Commission voices no opposition to this requested Variance. Mr. <br /> Varkonda stated the bank on this lot is located on Johns Pond and is very <br /> steep. He stated it is the Conservation Commissions belief that to cut <br /> into the bank and the subsequent traffic ?_n the area would cause damage <br /> to that inland bank. <br /> Mr. Hanrahan stated he has recieved a letter from abutter, J. Patrick <br /> Riley, who voices no opposition to the front setback however stated he <br /> would like the sideline setback to be enforced. Mr. Hanrahan stated the <br /> proposed house will be 34 x 26 feet. <br /> Mr. Hanrahan motioned to grant the front setback of 19 feet as re- <br /> quested due to the rear topography of the lot and grant the sideline set- <br /> back of 10 feet as requested due to the positioning of the leaching field <br /> and the shape of the lot, he stated there is no derigation to the intent <br /> of the by-law and the size of the house is not excessive to the lot, Mr. <br /> Sexton seconded, all agreed. <br />
