8 <br /> MINUTES April 1, 1987 BOARD OF APPEALS <br /> Gary✓ Tavares - Requests a Special Permit under Section 6.3, subsec- <br /> . _ .. <br /> tion I-9 of theLand Use Requirements for permission to construct re- <br /> movable floating docks in a R-3M Zoning District on property located on <br /> lot 5 Crescent road, (off Hooppole Road) , Mashpee, Massachusetts. <br /> Members sitting: W. Hanrahan, C. Hawver and T. Sexton. <br /> Mr. Gary Tavares was in attendance representing himself, Mr. John <br /> Varkonda, Conservation Officer, was also in attendance. There were no <br /> abutters present. <br /> Mr. Tavares stated he has received an order of conditions for the <br /> exisitng dock. <br /> Mr. Hanrahan stated he has received a letter from the Mashpee Con- <br /> servation Commission Officer which states, "the floating dock is 32 feet <br /> in length with 5 feet of water at the end. The concern that I have is <br /> the length, could not the dock be. shortened. A dock of 20 feet -would <br /> be enough for docking a boat and for swimming". <br /> Mr. Varkonda, Conservation Officer, presented himself before the <br /> Board and stated the length of the dock is in excessive. He stated in <br /> an effect to minimize any impact and shorten the visual impact, a 20 <br /> foot dock would be more then adequate. <br /> Mr. Tavares stated, when the water table lowers, and it does dras- <br /> tically drop, there may be only two or three feet of water. He stated <br /> he does not want to have to add to the dock in future years. <br /> Mr. Varkonda stated there is a problem arising with the amount of <br /> boats being docked on one dock. <br /> Mr. Hanrahan motioned to grant the Special Permit as requested with <br /> the stipulation this Applicant comply with all "Orders of Conditions set- <br /> forth by the Mashpee Conservation Commission, Ms. Hawver seconded, all <br /> agreed. <br /> James Porciello - (discussion) <br /> Mr. Kevin Kirraine was in attendnace representing Mr. Porciello. <br /> Mr. Kirraine presented original plans of the project and stated <br /> the Board has issued a Special Permit and Variance for Bay View Condo- <br /> minium development. <br /> Mr. Kirraine stated his client has entered into an agreement to <br /> acquire an abutting piece of property which has a seasonal residential <br /> structure on the site. Mr. Kirraine stated what his client is propos- <br /> ing to do is to move the proposed building (shown to the Board) which <br /> is permitted under the Special Permit, to a location (shown to the <br /> Board) and to remove the seasonal dwelling and seek a further modifica- <br /> tion for one additional unit. <br /> Mr. Kirraine presented the proposed plans for this five unit build- <br /> ing to the Board. Mr. Kirraine stated he is present this evening to <br /> question the Board on whether this is a permissible modification of the <br /> Special Permit. <br />
