Off of Blue Caste Drive an old dirt road <br /> remained with a lot of potholes and ditches. Mr. Morin was only required to pave a portion of <br /> that road where the units were. Several people liked the dirt road and did notwant it to be <br /> paved. The area of the new units has 10-15 ft. of paving past the first few houses, then 300 <br /> yards of dirt road, and finally the new pavement that circles Carriage Rd. and becomes dirt <br /> again. The drainage was adequately mitigated, there is a hold of$89,000 from the bank. <br /> Mr. Morin, the applicant, took care of a number of these items. Ed Pesce, Consulting Engineer, <br /> created a list of items for the applicant to complete. The applicant came before this Board, and <br /> it was voted to approve the release, subject to a $2,000 surety payment, most notably to <br /> vegetate and seed the swales on Carriage Rd. This Board also discussed the `attractive <br /> nuisance' that are the dirt piles which remain. The vote was limited to this condition, and Mr. <br /> Pesce's memo noted the swales. On July 17th, Tom Fudala was acting Town Planner, and on <br /> November 16th, he had the Board sign to release the tripartite, but hold in escrow until the <br /> $2,000 surety was collected. At this time, the surety has not been received. <br /> Mr. Morin would like to speak on this matter when Ed Pesce is present. Mr. Pesce will be <br /> available next meeting. <br /> Mr. Balzarini reported on the status of the swales, one had been raked out and one had been <br /> fertilized. The second one had been graded with no seeding. A lot of the grass looks dead. The <br /> two catch basins have a lot of leaves on top that are covering the drainage. It would be wise to <br /> collect and guarantee this is maintained. <br /> PUBLIC COMMENT <br /> Tim Dorsey- He commented that the drainage by Blue Castle Drive and Carriage Rd. is <br /> supposed to drain water and take out nitrogen. The two drains closest to Blue Castle Drive <br /> were filled with water and it hadn't rained in a long time. It was noted that may be the water <br /> table. The Tripartite Agreement is associated with the conditions on the permit. Condition 34 in <br /> particular, performing maintenance, leveling, grading, of entire length of Blue Castle Drive. <br /> There are still so many problems. This developer is notorious for scheduling meetings and <br /> canceling at the last minute. <br /> Chair Waygan will add this to the agenda for April 16th.A point of clarity for the record, those <br /> were findings, not conditions. <br /> AD STM Warrant Article 24 <br /> There are proposed amendments to the Zoning Bylaw for Accessory Dwelling Units. The <br /> Finance Committee and Select Board both recommend. A Public Hearing will be held on April <br /> 30th at 7:10PM, the meeting opens at 7:OOPM. A recommendation will be made for Town <br /> Meeting. <br /> 2 <br />
