It ended
exclusionary zoning for single family housing. Now, by-right 4 story and 6 story units can be
built under special permit, which 20% will need to be affordable. They are going to permit
3,500 units in 15 years. Realtors and developers are tearing down homes and building
apartments.
Ms. Waygan noted there is a five-year plan for growth through the Executive Office of Housing
and Livable Communities. She will be
providing documents to the Affordable Housing Committee for their next meeting.
Mike Perkins— He was seeking clarification on the five-year plan for housing, 2% growth, and
the no building of single-family homes.
Ms. Waygan read a press release saying each city and town needs to have growth in their
residential units. Off Cape, it was closer to 10%, and 2% on Cape Cod. It's not related to
affordable, just overall units. What she said was, if we bring on a number of affordable units,
we would meet that new 2% growth goal.
Ms. Waygan has been promoting another 30-day comment period. The plan gets approved by
the Planning Board, Select Board, then the state.
Proposed Raze and Replace By-Law
This expands past Raze and Replace, when we discuss Preexisting Non-Conformities. There
is a host of case law that interprets this section of the statute, it is a very sophisticated chapter
that causes a lot of confusion, even with experienced Land Use Attorneys.
