There needs to be a
custom craft finding by the local Board. There is state law, zoning, and code, the concerns of
residents in Popponesset, FEMA, floodplain, Ma Wetland Protection Act, and jurisdictional
concerns. The Conservation Commission has been crafting a new adaptation.
Mr. Tobin noted 12 months would allow for a draft, but progress needs to be made on this.
Ms. Waygan doesn't want to force a situation that would bring on a citizen's petition. She
wants to partner in this. It has already passed Town Meeting, we just need to change what's
written. It does not address comments from the workshop. With the home rule petition, we can
have stricter wetland regulations than the state. We can have that age in place that the
residents want.
Ms. Faulkner noted how lot coverage is calculated in the floodplain and on several occasions,
the ZBA has allowed larger homes. This is notjust about raze and replace, how can we
expand or alter within the footprint. She also noted the use of `not substantially more
detrimental'.
Ms. Waygan asked if more resources were needed to get this done, whether it be Town
Counsel or a consultant. We may be able to ask the Town Manager for a budget with
something like this. We should hold a charrette.
Mr. Tobin will devise a work plan with attainable goals and find a pathway.
NEW BUSINESS
Osprey Court Covenant Release
Mr. Tobin had a conversation with the applicant's attorney, the Native Land Conservancy will
hold this land.
Ms. Faulkner understands the holding by a non-profit, but what do they do?
It was stated that the land in open space is maintained, and any violations are enforced. If we
didn't have a conservation trust, garbage would be littered. No dumping or burning of trash is
enforced along with anything deemed not protecting open space.
Mashpee Corridor Improvements on Route 28 Rotary
This comment period started March 14th and will run for 30 days. This is regarding a shared
use path. Stantec is engaged with the DPW and Catherine Laurent. This will affect the
Mashpee rotary by the Mashpee Commons, Rt. 151, Great Neck Rd. and Falmouth Road
intersections.
Ms. Waygan noted there is a Vision Zero plan for no accidents, and this encourages people to
cross this intersection. We opted for no crossings at the rotary, but to retrofit and stripe. One
4
