C tr.
odldrL, edrr:idefi D21D9
IfKY
The Town of Mashpee, those of its Officials
that are concerned, and to whoa; else it may
Concern:
August 4, 1983
As your records disclose, I am the owner of certain land
that is situated abutting Turtle Back Road, at or near the
junction of Route 28 and Old Mill Road in Mashpee.
As you know, or should know, the Land Court for this Com-
monwealth entered a Decision on March 4, .1974, invalidating (on
Constitutional Grounds) the Zoning Amendment that was adopted
by a Special Town Meeting held on August 4, 1971, as it applied
to my land, thereby reinstating the Zoning to "Business" or, if
you will "Commercial".
As far as I am able to determine, all of your Town records,
except for your Assessing Depa-rtment, but including your recent
Zoning Maps and Town Clerk' s office, seem to show my land as
"Residential", notwithstanding the aforementioned Decision from
a Court of Competent Jurisdiction. To consider this a mere
oversight is beyond my comprea.ension.
Unless there is forthwith compliance w-?I tii she Land Court
Decision, I shall take that action I consider necessary to pro-
tect my rights and property.
I do bring to your atten.-F-ion the provi_s i ons of the United
States Civil Code, Title 42, Section 1983 (The Civil Rights Act)
Which provides for both compensatory and punitive damages for
violations thereof, and I ask you to consider your commissions
and/or omissions as applied to my land in light of this Act.
Very truly ,Tours,
MZS/b. ue Mai
1 Z. S.
cc: Town Counsel
Town Clerk
Board of Selectmen
Planning Board
