MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> MARCH 26, 2025 <br /> Mr. Blaisdell suggested that the application be continued to afford the applicant time <br /> to have a conversation with Mr. Morris. <br /> Mr. Mills asked for a continuance until Wednesday, April 23, 2025. <br /> Mr. Reidy made a motion that the Board accept the continuance until April 23, 2025. <br /> Ms. Sangeleer second. All were in favor. <br /> 27 Keel Way <br /> Mr. Chris Miller with Miller Pros represented the homeowners for their Written <br /> Finding request under Section 174-33 for a spa. Also present was Mr. Cauley, with <br /> Cauley Engineering who provided the site plan. The project involves a 7 ft. by 7 ft. <br /> spa that is located in the rear of the property. The setback requires 50 ft. setback <br /> from the wetlands. <br /> The Board asked for the existing lot coverage. The applicant provided the Board with <br /> a plan that depicts the lot coverage. <br /> The Board wanted to know the closest point of any existing structure to the <br /> wetlands. <br /> Mr. Cauley said the dimension from the house is 41.1 ft. The spa will be 46 ft. <br /> Mr. Goldstein said that the setback of the existing deck is 41.1 ft. from the <br /> saltmarsh, not the top of the coastal bank. <br /> The Board had a discussion and realized that the plan does not reflect the <br /> information they required. The entire property is located within Land Subject to <br /> Coastal Storm Flowage which means it has zero setbacks from lot coverage. <br /> Mr. Bonvie suggested that the applicant provide a revised plan that requires the <br /> existing structure coverage is (what)? and the proposed structure coverage is <br /> (what)?. There also needs to be a notation that 100% of the lot is located within the <br /> flood zone under Section 174-33 and MGL Section 131 Section 40A. <br /> Mr. Miller asked for an extension until April 23, 2025. Mr. Reidy made a motion that <br /> the Board accept the applicant's request for an extension and provide the required <br /> revisions to the plan. Mr. Furbush second.
