MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> MARCH 26, 2025 <br /> The house does not meet the current zoning setbacks except for the rear. The lot is <br /> not within a flood zone. The proposed work involves a new foundation which requires <br /> to lift the house and demoing out the old block foundation and replace the <br /> foundation in kind, and putting the house back in place. The only modification to <br /> the footprint is the bulk head will be relocated to the rear of the house and will help <br /> the setbacks which will be improving to the front at 30 ft. <br /> Mr. Reidy read the Conservation Department comments into the record, and the <br /> Board of Health comments into the record. <br /> Mr. Goldstein asked about the concrete slab in the rear. Mr. Benway said that it's a <br /> rinse station, and is remaining. <br /> Mr. Morris said he has no issues, and he said that it was a very good presentation. <br /> Mr. Bruce Colton and Sam Colton, lives at 9 Point Road. They have concerns with <br /> traffic increase on the street and emergency vehicles. They do not object to the <br /> project, only have concerns with the ability and the vehicles that require to access <br /> the road. <br /> Mr. Bonvie suggested that the abutters contact the police if there's an issue with <br /> road access. <br /> Mr. Benway said that the construction would probably take roughly five weeks. He <br /> said that he owns other properties on the road and could have available parking. <br /> Mr. and Mrs. Kelleher are abutters at 4 Point Road and are in favor of the project, <br /> and have no issues. <br /> Mr. Bonvie asked for a motion to close the public hearing. Mr. Reidy made a motion <br /> to close the public hearing. Ms. Sangeleer second. All were in favor. <br /> Mr. Reidy commented and thanked Mr. Benway for an excellent presentation. <br /> Mr. Reidy made a motion that the Board issue a Written Finding to 12 Bay Road <br /> with the following conditions: <br /> 1. The Board has determined that the applicant meets all the conditions of a <br /> Written Finding under Mass General Law 40A Section 6. <br /> 2. Site Plan - Proposed House Renovations for 12 Bay Road, Plan Date: October <br /> 17, 2024, Plan Scale: 1" = 10', Prepared by: Falmouth Engineering. <br /> 12 <br />
