<br /> Town of Mashpee Planning Board <br /> 16 Great Neck Road North <br /> Mashpee, Massachusetts 02649 <br /> <br />Ms. Waygan read the public hearing notice into the record. <br /> <br />Ms. Waygan stated with the state passing the Affordable Homes Act, it makes ADUs protected <br />and by-right, meaning it only requires pulling a building permit. The Mashpee Zoning Bylaw <br />was reviewed by Town Counsel to align with state law. <br /> <br />Summary of Changes: <br />- Eliminates requirement for owner occupancy <br />- Eliminates 2-bedroom maximum requirement <br />- Reduces parking requirements (parking eliminated if ADU is within ½ mile of transit <br />station) <br />- Max. of 900s.f. or 50% of Gross Floor Area, whichever is smaller, unless primary dwelling <br />is 800s.f. or less, there is a min. of 400 s.f. <br />- Definitions updated to adopt state definition of ADU <br />- State defines Gross Floor Area and how it’s calculated. <br /> <br />A transit station is not a bus stop, but it may be defined as such. Ms. Waygan asked Mr. Tobin <br />to follow up with the Building Commissioner, as he is the enforcer. We could also reach out to <br />the Cape Cod Commission; they have a transportation person that could provide a map of all <br />locations. <br /> <br />Mr. Tobin stated the draft redlines from Town Counsel’s office do not include a definition or use <br />capital letters indicative of any legal definition. He suggested looking into a state law definition <br />under the statute or CMR. <br /> <br />MOTION: <br />Mr. Balzarini made a motion to close the Public Hearing. Seconded by Mr. <br />Richardson. All in favor. <br /> <br />MOTION: <br />Mr. Richardson made a motion to recommend Town Meeting approve this <br />proposed amendment to Article 24. Seconded by Mr. Balzarini. All in favor. <br /> <br />7:20PM <br /> Applicant: Shellback Development LLC <br /> Location: 647 Falmouth Road/ 9 Shellback Way <br />Request: Special Permit to construct a 13,229 +/- SF specialty retail <br />grocery store on 3.97 +/- acres of undeveloped land <br />pursuant to Section 174-24C & 174-25E(1) & E(2) of the <br />Mashpee Zoning By-law. <br />2 <br /> <br /> <br />
