At that hearing, the Select Board shall review the record of the Commission's proceedings, <br />including meeting minutes and any documents submitted to or considered by the <br />Commission. Based upon its review, the Select Board shall determine if a reasonable <br />factual basis exists to support the Commission's decision. If the Select Board determines <br />that a reasonable factual basis exists, it shall uphold the Commission's decision. If the <br />Select Board determines there is not a reasonable factual basis, it shall direct that the <br />demolition delay be lifted. <br />E. Any person aggrieved by a final decision may appeal to the Superior Court in accordance <br />with G.L. c. 249, § 4. <br />VL Severability. <br />If any section, paragraph, or part of this Bylaw shall be declared invalid or unconstitutional by any <br />court of competent jurisdiction, then every other section, paragraph, and part shall be considered <br />separately and apart from the remaining provisions of this chapter, which shall continue in full <br />force and effect. <br />or take any other action relating thereto. <br />Submitted by the Historical Commission <br />Explanation: Passage of the Demolition Delay Bylaw will protect a piece of Mashpee history <br />that has been rapidly disappearing. Passage will enable Mashpee to join the vast majority of towns <br />on Cape Cod in preserving its historic housing stock. Houses more than 100 years of age and <br />deemed "historically significant" by the Historical Commission will face up to an 18-month delay <br />in demolition while the Historical Commission and the developer create a plan to preserve that <br />historically significant dwelling. <br />The Select Board recommends approval of Article 25 by a vote of 4-0 <br />The Finance Committee recommends approval of Article 25 by a vote of 6-0 <br />Motion made by Select Board Member Sherman <br />Motion: I move the Town vote to approve Article 25 as printed in the warrant, with the <br />exception of the phrase "or take any other action relating thereto." <br />Motion passes 190 to 14 at 9:28PM <br />
