• All proposed project work is contained within the existing pool fencing area <br /> • The closest portion of the project (landscape wall)is 58 ft from the top of the bank. <br /> Beach Access and Vegetation Management <br /> • The proposal includes a 3-foot-wide rollable cedar boardwalk mat for beach access <br /> • The mat will be staked down during the season and rolled up during the off-season <br /> • The area has already been planted with beach grass from the original order of conditions <br /> • The previous Japanese knotweed infestation will be largely eradicated <br /> • Native species have been planted along the waterfront as required <br /> • Beach grass is expected to spread and provide good coverage <br /> • Ornamental and non-native shrubbery will be replaced with native shrubs <br /> • Monitoring of invasive species control and native planting growth is ongoing. <br /> Technical Considerations and Conditions <br /> • The property's topography slopes away from the top of the bank toward the road <br /> • The pool features an infinity edge design with water recirculating in a basin <br /> • The septic system upgrade and fence are located within the New Seabury Golf Course <br /> easement <br /> • Nitrogen calculations indicate a reduction from 36,OOOmg to 19,707mg (45% reduction) <br /> • The calculated nitrogen level in the effluent is 18.99 ppm <br /> • The project is grandfathered to use previously existing buffer zone requirements (100 ft). <br /> Agent Comments <br /> • No proof of application to BOH. No ZBA jurisdiction <br /> • Original NOI application and subsequent issuance of OOC under the previous wetland <br /> buffer zone of 100 ft. This delineation is considered grandfathered as per previous legal <br /> clarification for similar occurrences/permit applications <br /> • No proposed alterations within LSCSF <br /> • All proposed alterations associated with the pool and patio, and septic system within the <br /> existing and previously approved hard scaped/landscaped areas <br /> • N loading Cals provided and meet PPM threshold under Reg. 30 <br /> • Reduction in overall lawn areas within jurisdiction (less than 10%) <br /> Motion <br /> • Mr. Cook made the motion to approve the amended order of conditions with the <br /> following conditions: <br /> 1. Pool water to be pumped out by truck and brought off-site <br /> 2. The lawn is within the conservation lawn regulations <br /> 3. Submission of a signed 3-year monitoring contract between the property <br /> owner and a qualified professional. <br /> 4. Easement approval from New Seabury <br /> • Ms. Godfrey seconded the motion. <br /> • Vote: Mr. Cook(Yes), Ms. Godfrey (Yes), Ms. Thornbrugh (Yes), Ms. Clapprood (Yes), <br /> Mr. Colombo (Yes).
