• The engineer offered to remove rocks and plant approximately 60 square feet of <br /> mitigation area <br /> • It was proposed to remove the hardscape walkway with cobble edging that would no <br /> longer be needed <br /> • A shellfish mitigation fee was calculated at $2,768 despite not being required. <br /> Additional Discussion <br /> • The commission discussed whether to require rebuilding the existing dock or allowing a <br /> new one <br /> • DMF recommended staying within the same footprint; however, the commission noted <br /> the benefits of the new design with conditions. <br /> Agent Comments <br /> • DMF comments provided —recommendations include working to restore the existing <br /> dock as opposed to building a new dock. Harbormaster has no navigational concerns. <br /> Shellfish Constable does not recommend a shellfish mitigation fee, as this area is not <br /> considered to have a viable shellfish population, nor is it commonly harvested due to <br /> existing moorings <br /> • The applicant consultant requested that Shellfish Constable provide calculations for the <br /> mitigation fee, as this form of mitigation would be preferred over upland mitigation. The <br /> commission can deliberate over this offer <br /> • Recommendations: <br /> o Through-flow composite decking on a portion of the fixed pier that spans over the <br /> salt marsh <br /> o Time of year restriction on construction activities from Jan. 1 st to May 31 st to <br /> protect winter flounder spawning activities <br /> o If a new dock is proposed, the agent recommends a condition of full removal of <br /> the existing dock prior to construction of the new dock, including full removal of <br /> all piles <br /> ➢ Department of Natural Resources: Harbormaster: I have no navigational or abutting <br /> concerns with the proposed construction and maintenance of a new dock, ramp, and float <br /> ➢ Department of Natural Resources: Shellfish Constable: Having reviewed the most <br /> recent application for a float,pilings, and decking within the Coastal resource areas (310- <br /> CMR 10-25-10-35). This project replaces the existing pier, floats, and piles in their <br /> original configuration with an additional 8 piles and 202 sgft of overall footprint. <br /> According to Mass Mappers, the area does not contain shellfish and is closed from April <br /> 1st—October 31st due to the mooring area adjacent to the project. This project will not <br /> be assessed a Shellfish Dock mitigation fee. <br /> Motion <br /> • Mr. Cook made a motion to close and issue with the following conditions: <br /> 1. The rocks must be removed <br /> 2. Revise the plan to show there is a 6 ft separation over the salt marsh <br /> 3. Re-vegetate the salt marsh <br /> 4. Install float stops at 1.5 ft (18 inches) height as per the regulation <br /> 7 <br />
