of TMs s,s <br /> z. <br /> AU�1MLIUV��y <br /> own qf MaS 2 Panning Board <br /> c� <br /> 16 Great Weck RoadWorth <br /> -Mashpee, -Massachusetts 02649 <br /> Request: Special Permit Modification to construct a 2,500 +/- SF <br /> restaurant with 44 seats (38 indoor and 6 outdoor seats) in <br /> the building G pad site, pursuant to sections 174-45.1 of the <br /> Mashpee Zoning By-law. <br /> Ms. Waygan read the Public Hearing notice into the record. <br /> Present this evening is Attorney Eliza Cox from La Tanzi Spaulding & Landreth, joined by <br /> Karen Johnson of Brand Street Properties, Matt Eddy with Baxter& Nye Engineering, and Tom <br /> Scott from Scott/Griffin Architects. This Board is familiar with this property, a 25-acre site on <br /> Rt. 28, Donna's Lane, and Great Neck Road South. This is a shopping center with significant <br /> prior permitting with DEP, the Cape Cod Commission, and the Town of Mashpee. The last time <br /> they were before this Board was in 2021 seeking a modification for this location. <br /> In 2022 there were numerous modifications, and the DRI at the Cape Cod Commission is still <br /> in effect with a couple extensions, the last one being in 2022 that extended to 2027. Last fall <br /> the state issued the Permit Extension Act that added an additional 2 years. The CCC permit <br /> requires complete construction within that time frame, while the Town requires construction <br /> start within that time frame. <br /> The existing floor area is 140,000s.f., which is less than authorized. There are 7 buildings <br /> known as A-F as well as H, and a wastewater treatment center. Building G was originally to be <br /> constructed at a 10,000s.f. footprint. During the HomeGoods development, 11 additional <br /> parking spaces were added in the vicinity of Building G, resulting in the Board approving future <br /> Building G to maintain a smaller footprint at 6,000s.f. In 2021, they appeared before this Board <br /> for Building G, in September it was approved to build out two retail tenants in a single-story <br /> footprint. The Board also approved reduced setbacks as part of the 2021 Special Permit <br /> Modification. <br /> Matt Eddy with Baxter& Nye Engineering and Surveying showed the site plan on the screen <br /> with the reduced footprint of the newly proposed Chipotle. This footprint is smaller with a <br /> similar layout and the parking layout is similar to what was approved. The handicap spaces <br /> were reconfigured and provided at the east end. Off South St. is a loading dock. The setback <br /> from 2021 has been increased from the building to what is now Charles St. The Landscape <br /> Plan shows a small stone retaining wall and outside patio area. The trees in the corner were <br /> relocated and changed to shrubs and grass. The site line distance from South St. to the <br /> intersection is unobstructed. The pear trees were changed to dogwood. There are two bollards <br /> outside the patio to protect cars from driving into patio seating. <br /> Mr. Tobin discussed the documents included in the packet this evening, noting all revisions <br /> and correspondence, and the most updated plans are labeled 3.1. <br /> 2 <br />
