MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> MAY 14, 2025 <br /> Mr. Reidy made a motion that the Board issue a Special Permit to Paul F. Hanley <br /> and Jean J. Hanley under §174-17.1 and §174-33 of the Zoning Bylaws to raze <br /> and replace an existing single family residential structure with a new single <br /> family structure on property located in the Popponesset Overly District and R-3 <br /> Zoning District, Map 117, Parcel 306, Mashpee, MA with the following <br /> conditions: <br /> 1. The Board has determined that the applicant meets all the conditions of a <br /> Special Permit under Mass General Law 40A Section 9. <br /> 2. Site Plan -Prepared for Paul Hanley, Project: 42 Nick Trail, Mashpee, MA. <br /> Date: February 28, 2025, Prepared by: Cape & Islands Engineering, <br /> Stamped and signed by: Mark Dibb, No. 45937, and Jacob Fricke, No: <br /> 59305. <br /> 3. Building Plans: Prepared for: Hanley Residence, Date: 2/26/25, Sheet 1: <br /> First 8v Second Floor Plans, Sheet 2: Elevations, Prepared by: ArchiPlicity, <br /> LLC. <br /> 4. Conditioned on all Town Department comments read into the record <br /> including but not limited to the Board of Health and Conservation <br /> Department comments. <br /> S. Any changes to the plans will require the applicant to return to this Board. <br /> 6. Conditioned that the applicant seek and obtain the Building Department <br /> review in reference to the Tree Bylaw Chapter 175 of the Town Bylaws prior <br /> to the application of a building permit. <br /> 7. The Board finds under §174-17.1 and §174-33 that the proposed project <br /> as submitted is not substantially more detrimental to the neighborhood <br /> than the existing conditions prior to removal of the existing structure, and <br /> that there is adequate land area on the subject lot to provide sufficient <br /> parking, and there are no new nonconformities being created. <br /> Ms. Sangeleer second, yes, <br /> Mr. Furbush, yes, <br /> Mr. Ganzenmuller, yes, <br /> Mr. Reidy, yes, <br /> Mr. Bonvie, yes <br /> All were in favor to issue a Special Permit <br /> 8 <br />
