MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> MAY 14, 2025 <br /> There were no comments submitted from the Harbormaster. <br /> Ms. Sangeleer said that all fresh water docks have to be approved by the State, <br /> and the Harbormaster needs to inspect the dock. <br /> Attorney Kirrane said that he cautions the Board because docks are exempt from <br /> Zoning. Mr. Morris said that he agrees with Attorney Kirrane that the Board <br /> should only be concerned with the stairs, pump house and deck which require <br /> a building permit, and require Building Department inspections. Mr. Morris also <br /> signs a Chapter 91 request for the dock. He had no more comments or concerns. <br /> There were no more comments from the Board. <br /> Mr. Bonvie asked for a motion to close the public hearing. Mr. Ganzenmuller, so <br /> moved. Ms. Sangeleer second. All were in favor. <br /> Mr. Reidy made a motion that the Board issue a Written Finding to Owner, Darryl <br /> Stuart Sharpe under §174-17 and §174-33 of the Zoning Bylaws to allow for <br /> construction of access stairs to a proposed dock, repair an existing deck and <br /> pump house all within 50 ft. setback to wetlands on property located in an R-5 <br /> Zoning District, Map 20, Parcel 9, Mashpee, MA with the following conditions: <br /> 1. The Board has determined that the applicant meets all the conditions of <br /> a Written Finding under Mass General Law 40A Section 6. <br /> 2. Site Plan- Prepared for: Darryl S. Sharpe, Project: 27 Sturgis Lane, <br /> Mashpee, MA. Sheet No. 1 of 1, Date: January 13, 2025, Date: 3/4/25: <br /> Revised Driveway Layout Add Grading& Pier Details. Date: 4/29/25: Add <br /> Mitigation, Drainage and Adjust Pier Length. Prepared by: Cape & Islands <br /> Engineering, Stamped and signed by: Charles Rowland, No: 52699, and <br /> Jacob Fricke, No.: 59305. <br /> 3. Conditioned on all Town Department comments read into the record <br /> including but not limited to the Conservation Department and Board of <br /> Health. <br /> 4. Any changes to the plans will require the applicant to return to this Board. <br /> 5.
