Conditioned on all Town Department comments read into the record <br /> including but not limited to the Board of Health and Conservation <br /> Department comments. <br /> S. Any changes to the plans will require the applicant to return to this Board. <br /> 6. Conditioned that the applicant seek and obtain the Building Department <br /> review in reference to the Tree Bylaw Chapter 175 of the Town Bylaws prior <br /> to the application of a building permit. <br /> 7. The Board finds under §174-17.1 that the proposed project as submitted <br /> is not substantially more detrimental to the neighborhood than the <br /> existing conditions prior to removal of the existing structure, and that <br /> there is adequate land area on the subject lot to provide sufficient parking, <br /> and there are no new nonconformities being created. <br /> Ms. Sangeleer second, yes, <br /> Mr. Goldstein, yes, <br /> Mr. Ganzenmuller, yes, <br /> Mr. Furbush, yes, <br /> Mr. Bonvie, yes. <br /> All were in favor to issue a Special Permit. <br /> 24 Seconsett Point Road <br /> Mr. Bonvie addressed the Board and suggested they read the KP Law letter <br /> regarding this hearing. He specifically mentioned Item B in the letter. <br /> Attorney Christopher Kirrane addressed the Board that a letter was submitted <br /> by Town Counsel, but there was additional information that they requested as <br /> part of their opinion. That additional information was submitted to Town <br /> Counsel, but they have been unable to address due to other time constraints, <br /> and therefore Mr. Kirrane requested a continuance until June 11, 2025. <br /> Mr. Morris addressed the Board that he also sent a request to Town Counsel that <br /> overlaps another issue, but he agrees that the Board did the right thing. <br /> Mr. Bonvie agreed that the Board followed the correct procedure to request the <br /> opinion from Town Counsel on this petition. <br /> Mr. Bonvie asked for a motion to continue the hearing until June 11, 2025. <br /> 4 <br />
