MASHPEE ZONING BOARD OF APPEALS <br /> DECISION FOR A WRITTEN FINDING <br /> Owner, Stanley M. Hargus, Trustee of the <br /> Stanley M. Hargus 2004 Trust <br /> 80 Whippoorwill Circle (Map 125, Parcel 185) <br /> Mashpee, MA 02649 <br /> FINDING-2024-58 <br /> There will be flood vents installed,and a single-car garage on grade with flood vents,and a kitchen <br /> and family room addition constructed on piers. This proposed work will be approximately 640 sq. <br /> ft. and will comply with all setbacks. This project was approved by the Conservation Commission <br /> on October 24, 2024. <br /> GENERAL FINDINGS <br /> The Conservation Department comments dated October 28, 2024 were read into the record; <br /> "Resource Areas: LSCSF & Buffer zone to Salt Marsh - NOI application was approved <br /> unanimously with the condition of a two year mitigation & monitoring contract with a certified <br /> professional. With the installation of multiple drywells to control roof runoff, installation of <br /> multiple flood vents, reduction of driveway area, and conversion of driveway area to native <br /> planting beds will enhance resource areas natural function. " <br /> The Board of Health comments dated November 6, 2024 were read into the record; "House to <br /> remain 4 bedroom, I on the first floor and 3 on the second floor. " <br /> The Building Commissioner commented that the applicant consulted a flood plain specialist and <br /> followed the correct procedure with a professional engineer. <br /> a <br /> The Board discussed the height of the structure that will be raised from 11.6 ft. to 14.1 ft. The <br /> Board stated that the proposed structure should depict the height on the building plan. This will be <br /> reviewed and determined by the Building Commissioner during the building permitting process. <br /> WRITTEN FINDING CRITERIA <br /> ARTICLE V -Nonconforming Buildings and Uses: <br /> §174-17. Continuance; Extensions; Alterations - Lawfully created structures or uses may be <br /> continued, although not conforming with the provisions of this chapter. Non-conforming single- <br /> or two-family dwelling structures may be changed, extended or altered if such change, extension <br /> or alteration complies with the dimensional requirements applicable to the lot under current <br /> provisions of§174-31 or, for lots which have been developed pursuant to §174-21, complies with <br /> such requirements as were applicable to initial construction of the dwelling under provisions of <br /> §174-21. <br /> 2 <br />
