Kwesell of KP Law, P.C. Amy e. Kwesell provided legal <br />guidance and gave a presentation on Chapter 40B, which allows developers to apply to the <br />Zoning Board of Appeals (ZBA) for a single comprehensive permit for residential projects. <br />While local zoning can be bypassed, state laws such as the Wetlands Protection Act and <br />Title 5 still apply. Projects must meet local need thresholds, including having at least 10% <br />a?ordable housing; Mashpee currently stands at 4.66% as of June 29, 2023. A Project <br />Eligibility Letter (PEL) is required before applying to the ZBA and confirms jurisdictional <br />requirements, including site control and project funding eligibility. Once received, the <br />application is distributed to local departments for comment. The ZBA must open a hearing <br />within 30 days and close it within 180 days. Peer review is allowed and paid for by the <br />applicant. The ZBA may approve, approve with conditions, or deny the project based on <br />whether it is reasonable and consistent with local needs. Developers cannot be required to <br />upgrade existing infrastructure, and any unit reduction must be based on valid planning <br />concerns. If denied, applicants may appeal to the Housing Appeals Committee. It was <br />confirmed that extensions may be requested in writing via email to MassHousing. <br /> <br />Public Comment <br /> <br />
