McManus, Conservation Agent <br />-Steve Cook, Vice Chair -Dan Kent, Assistant Conservation Agent <br />-Sarah Thornbrugh, Member - Amy Kwesell, KP Law, P.C. <br />-Alexandra Zollo, Member <br />-Marjorie Clapprood, Member <br />-Rich Sahl, Member <br />-Seana Pitt, Associate Member <br />-Neal Larson, Associate Member <br /> <br />CALL MEETING TO ORDER <br /> <br />5:30 <br /> Mr. Colombo called the meeting to order <br /> <br />Pledge of Allegiance/Moment of Silence. <br /> <br /> <br />190 Monomoscoy Road <br /> DEP 43-3258 <br /> <br />Legal Case Background <br /> Judge Perino issued a remand order for the KR versus the Commission case regarding <br />190 Monomoscoy property, requiring the commission to reconsider their denial of a <br />wetland permit <br /> No written findings were made regarding the effect of two prior orders of conditions from <br />2018, which the judge identified as a key deficiency in the original denial <br /> Limited clearing work was performed under the 2018 orders of condition, but no <br />structures were built before the permits expired <br /> Certificate of Compliance was issued for the 2018 work, effectively closing out those <br />permits without requiring revegetation <br />Current Property Status <br /> 75 ft naturally vegetated buffer strip is the current bylaw requirement, increased from the <br />previous 50 ft requirement <br /> Cleared area has not regrown based on recent observations, with stored firewood and <br />vessels still present on the property <br />1 <br /> <br /> <br />
