MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> JULY 9, 2025 <br /> Attorney Kirrane agreed and continued his presentation. The lot is wholly <br /> within the flood zone, and has two nonconforming issues as to lot area, and <br /> flood zone which is zero square feet, setback to wetlands zero, and 100% lot <br /> coverage. There are no setback issues. The proposed additions will be to the <br /> main house and the total lot area is 19,765 sq. ft. As a percentage is 5.9% with <br /> the proposed structure it is 10.4% and under the 20%. The project was <br /> approved by the Conservation Commission, and there is a storm water <br /> management included on the plan. <br /> Mr. Reidy read the Board of Health comments into the record, and the <br /> Conservation Department comments. <br /> Ms. Sangeleer is concerned that the ADU was included in the presentation, and <br /> is in the flood zone. <br /> Mr. Bonvie has concerns that the plan only depicts a dry well in the driveway <br /> but there is not a detail showing a drywell in the backyard. Mr. Bonvie stated <br /> that there is a state law that there cannot be an extension of the velocity and/or <br /> the extent of the water leaving a site. <br /> Mr. Bonvie wants the H2O calculations added to the plan for the backyard. <br /> The Board had a discussion and agreed that the best option would be to <br /> continue the hearing until August 13, 2025 that includes the revised <br /> advertisement of the garage and ADU. <br /> Mr. Bonvie asked for a motion to continue the hearing. Mr. Reidy so moved. Ms. <br /> Sangeleer, second. All were in favor to continue the hearing until August 13, <br /> 2025. <br /> 68 Nicoletta's Way <br /> Sitting on this hearing are the four regular Board members and Mr. Reidy. <br /> Attorney Christopher Kirrane represented the applicant's request for a <br /> modification of an existing Special Permit to allow for a dog rescue business <br /> located in the I-1 zoning district. Also present was Ms. Toni Eaton, the <br /> applicant. The original Special Permit was approved for warehouse and storage <br /> of commercial businesses. Mr. Kirrane provided the Board photographs of the <br /> proposed unit, and a detailed description of the indoor floor plan that will <br /> provide safe kennels. <br /> 8 <br />
