MASHPEE ZONING BOARD OF APPEALS <br /> MEETING MINUTES <br /> AUGUST 13, 2025 <br /> Mr. Reidy read a letter into the record from Mr. Morris dated August 8, 2025. <br /> The Board read the comments into the record from the Conservation Department <br /> dated August 12, 2025; "Resource area buffer zone to salt marsh and LSCSF Ny <br /> application received approval with a 4 tol vote from commissioners due to IIA <br /> septic installation,flood compliant foundation mitigation planting plan and drywall <br /> installation. Conditions for approval are gravel installed under decks. Walkway <br /> changed from impervious to pervious material design/specs on drywalls. Six red <br /> cedar trees added to overall mitigation planting plan and three-year mitigation and <br /> monitoring contract with the qualified professional." <br /> The Board read the comments into the record submitted by the Board of Health. <br /> "Septic plan must be submitted or reviewed to health department." <br /> The Board read several letters into the record from abutters that were submitted <br /> by; Richard E. Moore, Clifford Sands, Judy Peeples, Michael Procek, Carol <br /> Sherman, Richard Saladyga, Cindy Jones, and James Curry; all are in opposition <br /> of the proposed project. <br /> Mr. Bonvie explained his reasons as one member that he disagreed with <br /> Attorney Wall's arguments concerning M.G.L. 40A Section 6 and grandfathering <br /> protection concerning flood plain. <br /> Mr. Bonvie polled the Board for their comments. Mr. Caggiano agreed with the <br /> Building Commissioner's decision. Mr. Reidy could not support the applicant's <br /> request. <br /> Mr. Ganzenmuller could not support the applicant's request and agrees that <br /> the lot is not buildable. He had concerns that the lot was cleared of trees, and <br /> that construction equipment was being stored. <br /> Mr. Furbush had concerns with the lot being used for storage. <br /> Mr. Goldstein said he has been on the Board for a long time, and as a home <br /> builder for almost 40 years, he has never seen anything remotely close to allow <br /> this lot an approval as a buildable lot. <br /> Ms. Sangeleer had concerns with the size of the lot, and cannot imagine it is <br /> buildable. <br /> 9 <br />
