MASHPEE ZONING BOARD OF APPEALS MEETING MINUTES AUGUST 13, 2025 Mr. Goldstein asked Mr. Morris if the new FEMA rules affect a full remodel if the house is at elevation 11.7 ft. Mr. Morris said No, it's a substantial improvement; it might have major implications on the house. The house might have to be raised up. It's not a zoning issue, it's a building code issue. Mr. Bonvie suggested to Attorney Kirrane to have a conversation with the Owner because the improvement may be above 50% of the value of the home. There were no comments from the audience. There were no further comments from the Board. Mr. Bonvie asked for a motion to close the public hearing. Mr. Furbush so moved. Ms. Sangeleer second. All were in favor. Mr. Bonvie asked for a motion for the application. Mr. Reidy made a motion that the Board issue a Written Finding to Owner, Edward J. Farley under §174-17 of the Zoning Bylaws to allow for construction of a second floor addition to the existing house, a deck to the easterly side of the existing house, add a roof over the stoop at the front of the existing house, and a detached garage with an (ADU) Accessory Dwelling Unit above with the following conditions: 1. The Board has determined that the applicant meets all the conditions of a Written Finding under Mass General Law 40A Section 6. 2. Site Plan - Prepared for: Edward J. Farley, 8 Nehoiden Rd, Mashpee, MA. Sheet No. 1 of 1, Date: May 8, 2025, Revised: 7/ 11/25: Revise Drywell Design. Prepared by: Cape 8v Islands Road, Stamped and signed by: Matthew Costa, No. 52282, and Raul Lizardi-Rivera, Civil Eng. No. 46845. 3. Design Plans - Al-01: First Floor, Second Floor, Al-02: South Elevation, East Elevation, North Elevation, West Elevation, Al-03 ADU First and Second Floor, Al-04: ADU Elevations. 4. Conditioned on all Town Department comments read into the record including but not limited to the Conservation Department and Board of Health. 6
