of TMs s,s <br /> z. <br /> AU�1MLIUV��y <br /> own qf MaS 2 Panning Board <br /> c� <br /> 16 Great Weck RoadWorth <br /> -Mashpee, -Massachusetts 02649 <br /> Ms. Waygan clarified that the Board has reviewed two applications for adding land into <br /> existing, Willowbend as stated, and Tudor Terrace. <br /> Warrant Article 7 (Formerly Article 8): To see if the Town will vote to amend Section 174- <br /> 11: Lots located in multiple zoning districts <br /> When a parcel is split between multiple zones, i.e. commercial, industrial, or residential, egress <br /> access must be provided on the commercial or industrial side of the lot, not the residential. <br /> This is to mitigate commercial and industrial traffic in neighborhoods. <br /> Ms. Waygan elaborated this came about from an application with a commercial development <br /> that exited onto Ashumet Road over the commercial part of the lot. <br /> Public Comment <br /> Joanne Peters- She resides behind the Sherwin Williams paint store off Rt. 151, she has been <br /> here a few times. When the applicant wanted to use her road for the Sherwin Williams <br /> entrance, she expressed concern for herself and the residents of the neighborhood. <br /> Ms. Waygan stated this amendment would protect her neighborhood, but any modifications <br /> would be a major trigger, and all abutters would receive a notice for a Public Hearing. <br /> Mr. Tobin added there are six different zoning types, 11 transition areas identified, but only 10 <br /> are applicable to this scenario. We are only concerned with a transition area that has a split <br /> zone lot transitioning from one zone to another. <br /> - Warrant Article 8 (Formerly Article 9): To see if the Town will vote to amend Section 174- <br /> 47(7): Solar Energy Systems and Section 174-25(H)(12): Other principal uses <br /> This amendment would provide clarity for waivers in i1, and abutters to receive notice. <br /> Mr. Tobin elaborated that presently there is no avenue for an industrial zone applicant seeking <br /> a medium/large scale solar to appear before the Board for a waiver. All other districts require a <br /> Special Permit from the Planning Board. This means if you are seeking waivers, you go before <br /> the Board through a Special Permit. If no waivers are sought, you go through Plan Review <br /> Committee. <br /> Mashpee's solar provision is robust, but the Attorney General's office may take a closer look at <br /> this. There is a caution that the Supreme Judicial Court of MA has been geared towards a pro <br /> solar policy that prohibits unreasonable restrictions on solar. <br /> - Warrant Article 9 (Formerly Article 10): To see if the Town will vote to amend Section <br /> 174-27(2): Stormwater Management <br /> 2 <br />
