A system is designed, to artificially put the rain back into the ground, to <br /> simulate natural predevelopment conditions. This could be a raingarden. Post development <br /> there are pollutants and sediments, so total suspended solids are treated through a TSS <br /> removal system. He noted on these plans, 90% TSS and 60% phosphorous removal per DEP. <br /> They will provide an update for Town Meeting on October 20t" at 7:OOPM at Mashpee High <br /> School and Ms. Waygan asked Mr. Tobin to inform the Town Moderator that Ms. Belfit will be <br /> there to answer questions. <br /> - Warrant Article 10 (Formerly Article 11): To see if the Town will vote to accept a layout of <br /> a public footway and bicycle path. <br /> Ms. Waygan explained this easement is registered in the Barnstable Registry of Deeds as <br /> Land Court #669351, to allow bike path easement located at Rt. 28 and Shellback Way over <br /> Lots 19 and 20, per Land Court Plan 35550G to remain in perpetuity, the area is already paved <br /> and being used as a footway and bicycle path. <br /> Mr. Tobin showed the aerial view of Shellback Way and the bike path. He updated the Board <br /> that this has not been voted on at Town Meeting, the Town already has this easement, there <br /> just has not been a vote to accept the layout. Due to the word layout being used, he has been <br /> given the go ahead and Town Meeting could vote as is, or more conservatively, follow the <br /> statute provisions for a layout, to ensure compliance and avoid issue. If we are fixing a <br /> problem, we shall ensure no further problems can arise, and we should put on the Warrant for <br /> spring. Further steps in volve the Select Board voting to accept the layout then it involves the <br /> Planning Board vote and a recommendation to Town Meeting. <br /> Ms. Waygan's sole concern is the pending application before them pertaining to this lot. <br /> Mr. Tobin explained it's already our easement, it's already in the Land Court, per the 99 years <br /> from 1987, we have 65 years. He will need to do a thorough legal analysis. Adopting as a <br /> layout is to convert the 99 years to in perpetuity. <br /> MOTION: <br /> Mr. Balzarini made a motion to close the Public Hearing.
